HomeMy WebLinkAbout1988 Service Agreement with Auxiliary Services of MSU . , . . , . . . 1 FISCAL YEAR 1988 SERVICE AGREEMENT THIS AGREEMENT, dated July 1,1987, is made by and between AUXIL- IARY SERVICES of MONTANA STATE UNIVERSITY, Bozeman, Montana, hereinafter referred to as AUXILlARIES/MSU" and the CITY OF BOZEMAN, Bozeman, Montana, herei nafter referred to as II CITY. 11 In accordance with the previously accepted recommendations, it is in the interest and the intent of AUXILlARIES/MSU to provide support for the employment of additional CITY firefighting personnel so that Fire Station No. 2 can be operated on a full-time basis. This support will not include the provision of any state-appropriated funds to subsidize the cost of current services to Montana State University by the Bozeman Fire Department. This financial support will be from auxiliary revenues for additional services which will enhance the level of fire safety in the AUXI L1ARY /MSU facilities. Both parties are desirous of accommodating the above-described con- cerns. Pursuant to this desire, they have agreed as follows: 1. The conditions of this agreement shall be in accordance with the general intent expressed in the IIMemorandum of Under- standing for Support of Personnel at Station No. 2,11 dated August 30, 1984, a copy of which is attached as Exhibit 1. 2. The term of this ag reement shall be from July 1 , 1987 through June 30, 1988. This ag reement shall expire on June 30, 1988, unless extended by mutual written agreement of the parties before July 1, 1988. 3. The CITY will continue to employ sufficient personnel to operation Station No. 2 in such a manner to provide service to its first call area on a full-time basis. 4. In addition to firefighting services, the personnel at Station No. 2 wi II devote a sufficient percentage of thei r time, upon request of AUXILlARIES/MSU, to provide for all necessary fire prevention activities, including staff training, esca pe routes, dri II procedures and equipment recommendations. 5. Pursuant to Article 4, prior to the fall opening of the MSU halls, the CITY firefighting personnel wi II cooperate with MSLJ personnel in the annual Fire Safety and Evacuation Training Seminar for all 1987-88 residence life personnel. 6. During the term of this agreement, AUX I LIAR I ES/ MSU shall contribute to the cost of wages, benefits and retirement contributions for those personnel operating Station No. 2. The level of this support shall not exceed Sixty-nine thou- sand four hundred ninety-six and no/l00 dollars ($69,496.00) per annum. (See Exhibit 2 attached.) 7. AUXILlARIES/MSU will also contribute to the cost of capital improvements. This level of financial support shall not . . ' . I . exceed Four thousand five hundred eighty-five and no/l 00 dollars ($4,585.00) for the term of this agreement. (See Exhibit 2 attached.) 8. The CITY will bill AUXILIARIES/MSU according to the fol- lowing schedule: Quarter Invoice Date Amount 1 September 1987 $18,520.25 2 November 1987 $18,520.25 3 February 1988 $18,520.25 4 May 1988 $18,520.25 9. To accommodate a timely renewal of this agreement, on or before July 1, 1988, the CITy shall submit to AUXIL- IARIES/MSU a Fiscal Year 1989 OPERATIONS COST PRO- POSAL for Station No.2. 10. This agreement may, at the option of either party, be ter- minated and/or otherwise voided in either the event that the first call area of Station No. 2 is not operated on a full-time status or the event that the State of Montana de- cides to provide city services support through payment in lieu of taxes. This support will not include the provision of f any state-appropriated funds to subsidize the cost of current services to MSU by the Bozeman Fire Department. This support wi 11 be from auxiliary revenues for additional services which will enhance the level of fire safety in our auxiliary facilities. The specific elements which must be recognized as conditions of our intent are as follows: 1. Actual support shall be detailed and formalized, on an annual basis, through a signed agreement between the Bozeman City Manager and the MSU/OCL Director, with endorsements by the president of Montana State University and the mayor of Bozeman. 2. For any given year, the level of contribution from MSU shall not exceed that shown, in 1985 dollars, on the schedule attached hereto as Exhibit A. A. After FY-85 (July I, 1984 through June 30, 1985), the actual level of contribution for personal services will be determined, on an annual basis, by adjusting the amounts shown to reflect yearly wage/benefits/retirement increases provided to fire personnel through their contract with the city. B. After FY-85, the actual level of contribution, for capital will be determined through review of the city's proposed five-year capital items plan and its relationship to the operation of Station 12 and fire safety in OCL facilities. 3. This Memorandum of Understanding and any agreement entered into hereunder may, at the option of either of the parties, be terminated and/or otherwise voided in the event that the first- call area of Station 12 is not operated at substantially full-time status or in the event the State of Montana decides to provide city services support through payments in lieu of taxes. 4. In addition to fire-fighting services, the personnel at Station #2 will devote B sufficient percentage of their time to provide for all necessary fire prevention activities, including staff training Division of Student AHalrs and Services I , .. These services and the administrative relationship under which they will be performed will be reviewed and become part of the agreements signed each year. 5. The MSU contribution of FY-8S will not be firmly established until such time that new personnel have been employed and the service of the first-call area of Station 12 on a full-time basis is begun. 6. The city shall bill MSU quarterly in advance in the amount of the anticipated actual cost for the coming quarter. If the anticipated actual cost varies from the actual coat, an adjustment will be made in a subsequent billing. 7.
