Res. 5008, Intent to Consider Nexus Point Growth Policy AmendmentCommission Memorandum REPORT TO: Mayor and City Commission FROM: Sarah Rosenberg, Associate Planner Martin Matsen, Director of Community Development SUBJECT: Adoption of Resolution 5008, a resolution of intent to consider the Nexus Point growth policy amendment to amend Figure 3-1, the future land use map from Business Park Mixed Use to Residential Use on 20.18 acres on the west side of 19th Avenue, south of Stucky Road, and north of West Graf Street, Application 19014. MEETING DATE: February 11, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Adopt Resolution 5008, a resolution of intent to consider the Nexus Point growth policy amendment to amend Figure 3-1, the future land use map from Business Park Mixed Use to Residential Use on 20 acres along S. 19th Avenue, south of Stucky Road, and north of West Graf Street. BACKGROUND: The City of Bozeman adopted its current growth policy, the Bozeman Community Plan, on June 1, 2009 through Resolution 4163. Section 3.5, page 3-15, establishes the future land use. The map depicts various classifications of land described in Section 3.4 of the Bozeman Community Plan and the City’s expectations for the future use of that land. The applicant has requested a change in designation from Business Park Mixed Use to Residential Use. The description and intent of each of these future land use categories can be found in Chapter 3 of the Bozeman Community Plan. Passage of Resolution 5008 will not amend the growth policy. Rather, it will initiate the formal process, including notice to adjacent landowners, to evaluate whether the requested amendment is consistent with the overall policies and purposes of the growth policy. The Planning Board and City Commission will hold public hearings before any final decision. A full analysis of the review criteria found in Chapter 17 of the Community Plan will be included with the formal staff report prepared for the Planning Board and City Commission. WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958, and WHEREAS, the City of Bozeman adopted its growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009, and WHEREAS, the City of Bozeman adopted its most recent amendments to the text of the growth policy known as the Bozeman Community Plan (BCP) through Resolution 4195 on August 3, 2009, and WHEREAS, the Bozeman Community Plan, Section 17.4, establishes criteria for the amending of the document, and WHEREAS, an application has been received to amend Figure 3-1 the future land use map of the growth policy, and WHEREAS, in accordance with 76-1-602, MCA, the City Commission must adopt a resolution of intent and conduct a public hearing prior to taking any action to adopt or revise a growth policy, 158 Resolution 5008, Intent to revise Growth Policy Future Land Use Map - Nexus Point Page 2 of 2 NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that: Section 1 In accordance with the requirements of Section 76-1-604 MCA, the intent to consider the application for amendment and possible corresponding revisions to the growth policy is hereby stated. Section 2 That a public hearing be set and advertised for the purpose of receiving public testimony on application 19014, the Nexus Point growth policy amendment to Figure 3-1 of the Bozeman Community Plan with the Planning Board hearing on February 5, 2019 and the City Commission hearing on March 11, 2019.
