SUBJECT: Notice of Award to Omdahl Excavation and Utilities, Inc. in the amount of
$136,230.00 for construction of the 2019 Bozeman Stormwater Improvements
MEETING DATE: February 11, 2019

RECOMMENDATION: Authorize the City Manager to sign a Notice of Award for
construction of the 2019 Bozeman Stormwater Improvements to Omdahl Excavation and
Utilities, Inc., in the amount of $136,230.00 and the final contract documents, once received.
BACKGROUND: In 2014, the City Commission instructed Staff to implement a Stormwater
Division (Division) to manage public infrastructure, improve local waterway health, and comply
with regulations. Since, the Division has constructed projects, implemented programs, and
developed processes focused on achieving set goals. The 2019 Bozeman Stormwater
Improvements (Project) is a continuation of these efforts.
On January 29, 2019, the City Clerk opened seven bids for construction of the Project, which
involves the installation of two stormwater treatment units (units) located one-half block south of
the following intersections: W. Mendenhall St. and N. Black Ave., and W. Mendenhall St. and
N. Bozeman Ave. The Division selected the units’ locations because the roads, parking lots,
yards, and driveways contained within their watersheds have a direct connection to Bozeman
Creek, meaning no removal of stormwater pollutants currently occurs. Once constructed, the
units will treat stormwater flowing from 57 urban acres, and collect approximately 10 tons of
sediment, litter, and other pollutants annually.
Omdahl Excavation and Utilities, Inc. submitted the low bid of $136,230.00, which the Division
reviewed and found their prices reasonable and consistent with local costs. Attached is a copy of
the certified Bid Tabulation.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: Staff will pay for the Project with Stormwater Enterprise Funds approved
in the City’s FY19 Budget (Capital Plan Project STRM39).

PROJECT: 2019 Bozeman Stormwater Improvement Project
CONTRACT FOR: Installation of two (2) stormwater treatment units (units) located one‐half block south of
the following intersections: W. Mendenhall St. and N. Black Ave. and W. Mendenhall St. and N. Bozeman
Ave. The 2019 Bozeman Stormwater Improvements (Project) generally includes:
1. Traffic control
2. Excavating and uncovering existing storm mains within project extents
3. Adjusting existing utilities to accommodate work
4. Setting and connecting two (2) units to existing storm mains and manholes
5. Backfilling, compacting, and restoring disturbed areas
6. All related work incidental to construction
You are notified that the City of Bozeman (Owner) has considered your bid opened on January 29, 2019,
for the above Contract. The Owner has determined that you are the apparent successful bidder and is
awarding you the Contract for the 2019 Bozeman Stormwater Improvement Project. The price of your
Contract is: One Hundred Thirty‐Six Thousand Two Hundred and Thirty Dollars ($136,230.00).
You must comply with the following conditions within fifteen (15) days of the date of this Notice of Award,
that is, by________________________________. You must deliver the following to the Owner before the
aforementioned date:
1. Four (4) executed counterparts of the Agreement Form, including all Contract Documents and
Drawings.
2. Executed Agreement Form, Payment Bond, and Performance Bond as specified in the Instructions for
Bidders and General Conditions.
3. Certificates of Insurance as specified in the Supplementary Conditions (paragraphs SC‐5.04 and SC‐
5.06).
Failure to comply with these conditions within the time specified will entitle the Owner to consider your
bid abandoned, annul this Notice of Award, and declare your Bid Security forfeited.
The Owner will return to you two fully signed counterpart of the Agreement with the Contract Documents
attached within ten (10) days after you comply with these conditions.
