No. 4.

RECOMMENDATION: Approve and authorize City Manager to sign Amendment No. 4 with
Robert Peccia and Associates.
BACKGROUND: Attached is a copy of the partially executed Amendment No. 4 with Robert
Peccia and Associates for the 5.3 Million Gallon (MG) Water Storage Reservoir Project. The
document is in the City’s standard format.
Amendment number 2 added the bidding and construction phase services for the project. The
time and fee included in that amendment was based on the contact time included in the
construction contract, plus the additional time necessary to complete the project closeout tasks.
During the course of construction, there were a few time extensions granted to the contractor
with approved change orders. The contractor is now over on contract time including those
extensions. As a result, the consultant has exhausted the fees included in amendment 2 for
construction phase services. It is estimated that there is still 6 to 8 weeks of construction in the
spring necessary to complete the project. This amendment will add the additional construction
services to our consultants contract to complete the project. It is anticipated that the additional
inspection and contact administration time will be withheld from the contractor’s future
payments as liquidated damages. The construction phase services are paid on a time and
materials basis, so only those hours needed to complete the project will be compensated.

ALTERNATIVES: As suggested by the City Commission

FISCAL EFFECTS: $127,873.00 from the Water Impact Fee Fund (90%) and Water Fund
(10%). It is anticipated that the additional inspection and contact administration time will be
withheld from the contractor’s future payments as liquidated damages.
