Res 5010, Authorize CO 3 to the WRF Small Works Construction ProjectCommission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Heaston, Senior Engineer Shawn Kohtz, Interim Director of Public Works SUBJECT: Resolution 5010 Authorizing Change Order No. 3 to the WRF Small Works Construction Project MEETING DATE: January 28, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution 5010 authorizing Change Order No. 3 to the WRF Small Works Construction Project. BACKGROUND: Attached is Resolution 5010 and Change Order No. 3 for the above referenced project. The change order modifies the construction contract by adding in new work to install a new condensing boiler on the WRF heat loop. The new condensing boiler is necessary to provide additional heating capacity for the WRF heat loop system now that the WRF is operating at 100% digester capacity with the successful rehabilitation of digester number 1 and digester number 2. Heat calculations for the WRF indicate that the existing heat loop capacity is shy of meeting the full heat load of the plant with all three digesters running. Adequate heat capacity is imperative to ensure the proper and continuous operation of all three anaerobic digesters at the WRF during periods of extended cold weather. Should an extended cold snap be experienced under current heat loop capacity, the plant would be short of heat thus requiring at least one digester to be pulled out of service. Restarting digestion can be a finicky process and is not recommended. An opportunity exists to modify the WRF Small Works Project construction contract via change order to add the new boiler installation to the construction contract. The work will be completed by Williams Brother Construction, a qualified contractor currently bonded and insured to perform construction work for the WRF. The boiler addition is designed by HDR Engineering, who will also oversee construction to ensure compliance with plans and specifications. The approved FY19 budget includes a CIP project for the wastewater fund at $250,000 for the boiler addition (Project WW89 - ‘Heat Loop Optimization’. Change Order No. 3 increases the contract price by $147,400.00 and extends contract time to July 1, 2019 for substantial completion. 76 FISCAL EFFECTS: The FY19 wastewater fund CIP includes project WW89 – Heat Loop Optimization, which is allocated $250,000. Change Order No. 3 amends the contract price for the WRF Small Works Construction project to $1,192,874.63. Sufficient capital funding exists in the WRF budget to cover the total amended contract price. ALTERNATIVES: As suggested by the Commission ATTACHMENTS: Resolution 5010 Change Order No. 3 77 COMMISSION RESOLUTION NO. 5010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH WILLIAMS BROTHER CONSTRUCTION, LLC, SPOKANE, WASHINGTON WHEREAS, The City Commission did, on the August 28, 2017, authorize award of the bid for the WRF Small Works Construction Project to Williams Brother Construction, LLC, Spokane, Washington; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and Williams Brother Construction, LLC, as contained in Change Order No. 3, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 78 PASSED, ADOPTED, AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 28th day of January, 2019. ___________________________________ CYNTHIA L.
