INTERLOCAL AGREEMENT
BETWEEN THE COUNTY OF GALLATIN, AND THE CITY OF BOZEMAN
2006 BYRNE .JUSTICE ASSISTANCE GRANT (.JAG) PROGRAM AWARD
This Agreement if made and entered into this 19th day of April, by and between the COUNTY of Gallatin,
acting by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY,
and the CITY of BOZEMAN, acting by and through its governing body, the City Council, hereinafter
referred to as CITY, both of Gallatin County, State of Montana, witnesseth:
WHEREAS, this Agreement is made under the authority of Montana Code Annotated 7-11-101 et.seq.;
and
WHEREAS, each governing body, in perfonning governmental functions or in paying for the performance
of governmental flUlctions hereunder, shall make that performance or those payments from current
revenues legally available to that party: and
WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of
both parties, that the undertaking will benetlt the public, and that the division of costs fairly compensates
the performing party for the services or functions lUlder this agreement: and
WHEREAS, the CITY and COUNTY agrees to jointly use the $16,422 from the JAG award towards the
purchase of major crime scene vehicle which is an equal collaborative effort by the crry and the
COUNTY: and
WHEREAS, the CITY agrees to contribute $4061.50 and the COUNTY agrees to contribute $4061.50
towards the purchase of a crime scene vehicle: and
WHEREAS, the CITY and COUNTY agrees to jointly contribute to the insurance, gas, maintenance and
upkeep of the crime scene vehicle: and
WHEREAS, the CITY and COUNTY believe its in the best interests of the public to reallocate JAG funds.

NOW THEREFORE, the COUNTY and the CITY agree as follows:
Section 1.
CITY and COUNTY agree jointly to use the $16,422 of JAG funds.

Section 2.
COUNTY agrees to use $16,422 for the purchase of a County/City crime scene vehicle until June 30, 2011.

Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other
than claims for which applicable Montana State Statutes may impose liability.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than
claims for which applicable Montana State Statutes may impose liability.
Section 5.
Each party to this Agreement will be responsible for its own actions in providing services under this
Agreement and shall not be liable for any civil liability that may arise for the furnishing of the services by
the other party.
Section 6.
The parties to this Agreement do not intend to create any obligations express or implied other than those set
out herein; further, this Agreement shall not create any rights in any party not a signatory hereto.

GALLATIN COUNTY CRIME SCENE VEHICLE PURCHASE
PROGRAM NARRATIVE:
Gallatin County and the City of Bozeman, Montana are jointly submitting this application
for $16,422 in funding from the Justice Assistance Grant program (JAG) to facilitate the
acquisition of a crime scene investigation vehicle. The vehicle purchase is a
collaborative effort initiated by the Gallatin County Sheriffs Department and the
Bozeman City Police Department.
Gallatin County is a rural area of 2,606 square miles with a 2004 population of 75,637.
Not included in this total are the 12,250 students emolled at Montana State University.
These figures represent a population density with a low of 8 people per square mile in the
rural areas, and a high of 1,743 per square mile in the City of Bozeman. Population has
been increasing at the rate of 3.5% per year. The County is the fifth largest county in the
state. The current County population is expected to approach 100,000 by the year 2010.
Our rapid rate of growth has lead to an increase in the demand for services. Our ability to
provide an acceptable level of service to local residents is also challenged because of our
close proximity to Yellowstone Park and three major ski resorts. The area receives some
3.0 million tourists each year. Expanded recreational activities of our residents and
tourists demand that emergency services cover the entire County on a year around basis.
The coverage area includes extreme mountain topography further complicated by
extreme weather. Growth has also resulted in a significant increase of persons employed
in lower paying service related jobs. As these individuals seek affordable property and
housing they are expanding into the outlying rural areas. With this rapid growth has
come a significant increase in the types of events that require on site investigation of
. . Throughout the County we are experiencing an increase in
major cnme scenes. robberies, hostage situations, methamphetamine and drug related occurrences, and other
additional violent crimes.
Thorough crime scene investigation by law enforcement officials is important for proper
resolution of a case. Physical evidence has the potential to play a critical role in the
overall investigation and resolution of a suspected criminal act. The goal of the crime
scene investigation vehicle is to preserve physical evidence that will yield reliable
information to aid in an investigation. It would be financially unfeasible for the County to
invest any more resources into the maintenance and repair of the current vehicle.
The safety of the responding officers and their ability to investigate major crime scenes,
in the most effective manner is compromised.
The local increase in service expectations is counter balanced by a pressure to keep local
tax assessments low. Attempts for voter approval of a Public Safety Mill Levy have
failed. Life/safety and emergency response issues however, remain the primary service
delivery local government must meet. Financial resources for law enforcement are
severely limited. Our proposal requests' the ability to utilize the $16,422 available
through JAG to purchase a newer and appropriate response vehicle through a surplus

approved vehicle purchase program. The Gallatin County Sheriff s Department and the
Bozeman City Police Department will contribute all costs in addition to the $16,422 in
JAG flUlds on a 50/50 basis. Weare hopeful you will find that the circumstances
outlined in this proposal comply with the need to justify circumstance, which make the
use of JAG funds for a vehicle purchase essential.
