HomeMy WebLinkAboutOrdinance 06- 1666 Amending Official Zone Map Tract B COS 573 City of Bozeman/City Clerk PO Box 1230 Bozeman, MT 59771 ORDINANCE NO. 1666 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM R-S (RESIDENTIAL SUBURBAN DISTRICT) TO R-2 (RESIDENTIAL TWO-HOUSEHOLD, MEDIUM DENSITY DISTRICT) FOR 0.81 ACRES, ON PROPERTY DESCRIBED AS TRACT B O}' COS 573, PLUS ADJACENT HIGHWAY RIGIIT-O}'~WAY, LOCATED IN THE SOUTHWEST ONE- QUARTER OF SECTION 13, TOWNSHIP 2 SOUTH, RANGE 5 EAST, PRINCIPAL MERIDIAN MONTANA, CITY OF BOZEMAN, GALLATIN COUNTY, MONT ANA. WHEREAS, the proposed zone map amendment to amend the City of Bozcman Zone Map from R-S (Residential Suburban District) to R-2 (Residential Two-Household, Medium Density District) forO.81 acres, has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on January 2, 2006 to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, upon a vote of 3-0 the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment he approved as proposed; and WHEREAS, after proper notice, the City Commission held it's public hearing on January 23, 2006, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on January 23, 2006, the City Commission found that the proposed zone map amendment would be in compliance with Bozeman's adopted growth policy and would be in the public interest. - -.---------- NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby initially established as "R-2" (Residcntial Two-Household, Medium Density District): A tract of land being Tract B of Cel1ificatc of Survey No. 573, along with the Department of Transportation Bargain and Sale Deed (Film 125, Pages 382~384), locatcd in the Southwest One-Quarter of Section 13, Township 2 South, Range 5 East, Principal Meridian Montana, City of Bozeman, Montana, and being more particularly described as follows: Beginning at thc Northeast Corner of said Tract B; thence south 00029'34" West, a distance of 237.66 feet to a point on the centerline of Kagy Boulevard; thenee South 89"58'03" West, along said centerline a distance of 148.70 feet; thence North 00025' 14" East, a distance of 238.67 feet to the Northwest Corner of said Tract B; thence South 89038' 34" East, along the north line of said Tract B a distance of 149.00 feet to thc point of beginning. Said tract of land being 0.81 acres, along with and subject to any existing easements. Section 2 The effective date is thirty days after final adoption of this ordinance on seeond reading. PROVISIONAl,L Y ADOPTED by the City Commission of the City of Bozeman, Montana, on first reading, at a regular session thereof held on the 24th day of April, 2006.
