ORDINANCE NO. 1664
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP
BY ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF
R-O (RESIDENTIAL OFFICE DISTRICT) ON 3.1 ACRES DESCRIBED AS
TRACTS 17 AND 19 OFTHE HOMESITE SUBDIVISION, LOCATED IN THE
SOUTHWEST QUARTER OF SECTION 1, TOWNSHIP 2 SOUTH, RANGE 5
EAST, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amcndment to establish an initial zoning designation ofR-O
(Residential Office District) has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a publie hearing on July 19,2005, to reeeive
and rcvicw all writtcn and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission voted 4 to 0 in favor of the proposed zoning
dcsignation, and therefore forwarded a reeommendation of approval to the Bozeman City Commission; and
WHEREAS, after proper notiee, the City Commission held its publie hearing on August 1,2005,
and
WHEREAS, the City Commission has reviewed and eonsidercd the twelve zone change criteria
established in Seetion 76-2-304, M.C.A., and found the proposed zone map amendment to establish an
initial munieipa1 zoning designation of R-O (Residential Offiee Distriet), with eontingeneies, to be in
compliance with the twelve eriteria; and
WHEREAS, at its meeting held on August 1,2005, the City Commission found that the proposed
zone map amendment would be in compliance with the Growth Policy and would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:

Section 1
That the zoning district designation of the following-described property is hercby designated as
H.-O (Residential Offiee District):
That Part of the Southwest Quarter of Seetion 1, Township 2 South, Rangc 5 East,
PMM, Gallatin County, Montana, deseribed as follows: Tracts 17 ,md 19 of the
Homesite Subdivision; and further deseribed as, Commencing at the Northwest Comer
of said Tract 19, said point being on the east right-of-way of North 19th Avenue; Thence
North 89010'52" East, Azimuth 570.68 Feet; Thence South 00.39'23" East, Azimuth
240.00 Feet; Thenee South 89010'52" West, Azimuth 570.83 Feet; Thenee North
00"37'21" West, Azimuth 240.00 Feet to the True Point of Beginning
Said tract ofland being 3.1 acres along with and subject to any existing easements.
Section 2
The effective date is thirty days after final adoption of this ordinanee on second reading.
PROVISIONALL Y ADOPTED by the City Commission of the City of Bozeman, Montana, on
first reading, at a regular session thereof held on the 24th day of April, 2006.
FINALL Y PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman, Montana, on second reading at a regular session thereof held on the 15th day of May, 2006.
