Dear Bozeman City Ethics Board: This is a formal complaint submitted to you pursuant to MCA Sec. 2-2-144 for alleged violations by the City, city commissioners, and at their direction, or with their approval, numerous public employees. The necessary supporting documentation is attached and contained in my recently filed civil action, DV-16- 2018-1215C, which is now being held in abeyance. The underlying civil action contains my assertion that these individuals violated MCA Sec. 2-2-121(3) while engaging in acts connected to the recently concluded bond issue election. Similar to legal tactics being employed by the City itself, in filing a rather straightforward judicial matter with the Commissioner of Political Practices, I am forced to file this matter with you since the judicial action is principally in the form of an ethics complaint rather than a campaign finance question. In fact, the State Commissioner has very little authority with respect to the vast majority of the underlying issues. Even the authority the Commissioner has is subject to the Gallatin County Attorney's review, as the CoPP must refer his findings there. (See MCA Sec. 13-37-124). In compliance with MCA Sec. 2-2-144, I notified the Gallatin County Attorney. The County Attorney is holding my complaint because pursuant to MCA 2-2-144(5)(b) the complaint must be sent to the City and referred to your panel prior to making a complaint with a county attorney. This seems like an unnecessary time-consuming endeavor under the circumstances, because of the many conflicts of interest, required recusals and your limited authority. I agree it is the law, however. I do honestly believe you should refuse to accept my complaint or refer it elsewhere, due to the many inherent problematic deficiencies, which I now address. It is not my intention to impugn the board's integrity, but your system is clearly not designed to handle a complaint implicating more than a majority of the city commissioners and involves the City Manager and the City Attorney who quite probably provided them legal advice. A member of your own board is factually implicated in my complaint, and further investigation might reveal the involvement or support of other board members, though I am uncertain of that. In addition, your ultimate authority involves referring it to the accused (i.e. the city commissioners). (See, Bozeman Municipal Code Sec. 2.03.640(M)(4)(c) through (e)). The City Attorney is also implicated in this matter since it is entirely logical for one to assume that it is the City Attorney who consulted with commissioners, and perhaps the CoPP, regarding these issues, and consequently provided prior advice, as I have already indicated. Consequently, involving the City Attorney in this a matter will certainly give an appearance of impropriety. The City Manager is also named in the complaint as having participated in the questionable activity. All these individuals play vital roles in how you exercise your authority. All of them have conflicts of interest pursuant to BMC Sec. 2.03.520 and other sections of law. Ultimately your authority is severely limited because the complaint involves questions of misconduct and malfeasance, which require you to refer the matter to the accused or otherwise conflicted individuals named above. The only viable remaining option is to refer the matter to the Gallatin County Attorney's office, so for the sake of expediency, and efficiency you should do so now. (Id. at (d)). At this point, because I would like to see your extraneous involvement expedited, I am expressly foregoing the right to amend this ethics complaint. I simply ask that you review it and refer it to the Gallatin County Attorney for the reasons provided above. Should you seek to process the complaint, I will most likely seek to absolve you of your authority for engaging in what only amounts to an idle act that is a time-consuming unnecessary deviation. An idle act from which at least one of your three members is clearly conflicted, and already excluded, is certainly objectionable. Your authority provides no method for replacing a recused member. It is also objectionable and problematic when all members are appointed, and perhaps reappointed, by the accused (i.e. city 2 Y r commissioners). An ordinary person, acting reasonably and objectively, would clearly see that this scenario creates a conflict of interest. The City has already taken the position that time is of the essence, so I would expect that they would most likely concur that it is in everyone's best interest for you to dispose of the matter quickly and refer it to an appropriate legal authority. It is still my firm opinion that the proper and quickest means of resolving this matter is to allow it to continue in the District Court before Judge Brown. If, in the City's opinion, other alternatives should be exhausted, it is only appropriate that an ethics determination be made in conjunction with the campaign finance issues. Since conflicts lead to delays, and conflicts abound if the City seeks to decide upon these ethical issues themselves, the only appropriate and expedient way to handle my submitted ethics complaint is for you to recognize these deficiencies and refer it to the office of the Gallatin County Attorney, so he can then proceed pursuant to MCA Sec. 2-2-144. INTRODUCTION High ranking City of Bozeman public officials desperately wanted to pass a bond measure to construct a safety facility. The Bozeman City Commission voted unanimously to place a$36.9 million safety facility construction bond on the 2018 ballot for voter approval. Two similar issues were recently defeated by voters. City commissioners and public employees were clearly proponents of the measure. In addition to time, they used public facilities, equipment, and funding. They spent more than $67,600 on professional consulting 00 1 96-Koopman and Johnson et al v.City of Bozeman et at COMPLAINT -PAGE 1 OF 28 fees and public employee wages on outreach,promotion, logos, slogans, ads, handbills, buttons, t-shirts, signs, banners,posters, inserts, mailers and more. The campaign began in May and ended November 6, 2018 on election night. After unanimously voting to submit the bond question to voters, the City voluntarily created an incidental committee to urge voter support. City officials then created a second political committee under the guise of being a citizens group, Bozeman Citizens for Safety (BCFS) which City officials subsequently supported and, in fact, controlled. The one-sided promotional messaging with a three-part systematic approach was identical: Bozeman is Safe Let's keep Bozeman Safe Vote November 6" Use of power and public resources to propagandize in support of measure the government submitted to the voters is antithetical to popular sovereignty, self-government, suffrage and individual dignity (Mont. Const. Article 11). Proponents and opponents have an equal stake in the outcome of the election, and the City-led efforts assured only the proponent's message was conveyed to voters. Only proponents lead access to public_resources. In fact, Mir. Koopman was affirmatively denied access to City property to erect a simple sign v,+ich would oppose the bond. The City's political cornmittee report shows it used public resources to directly support the campaign. The fact that the City filed as a political committee is one example demonstrating they were actively urging voters to support the bond. Political committees support(or oppose) elections, by legal definition. (?\iCA § 13-1-101(7), (23) (3I)(a)). The City's promotional and comprehensively contrived message that "Bozeman is Safe. Let's Keep Bozeman Safe, Vote Nov. 6th,"unambiguously calls Bozeman, s voters to action urging them to support the bond measure. The message meets the standard of advocacy, and 00 1 96-Koopman and Johnson et a]v. City of Bozeman et a]COMPLAINT -PAGE 2 OF_'8 advocacy is prohibited. The City's slogans and messaging were the functional equivalent of advocacy. There was no other susceptible meaning which a voter can derive from the communication. Any person reading, or hearing, the message would clearly know they were being urged to vote in favor of the bond to avoid the dire consequences the City envisions. The City created, and controlled,political committee BCFS, had the exact same one- sided promotional message. Two of the three officers of BCFS are City commissioners, and eight of the nine BCFS contributors are public employees or officials. The City made numerous in-kind contributions supporting BCFS. In addition to using the same message, officers, employees and consultant.. BCFS used the City's slogan, Iogo and graphic design for its yard signs. To illustrate, the City paid Nest Collective (ahiest) thousands of dollars for messaging, a logo and graphic. design. BCFS paid Nest just over $100. This alone establishes that the City supported BCFS. The_relationships are not merely happenstance or by simple association. The City interprets MCA § 2-2-121(3) to alloy,-their one-side self-promotion because the law contains a narrow exemption for a limited amount of purely educational activity. The educational exemption assumes the government has the power to use resources to inform the electorate about issues, but there is strong legal precedent requiring fairness and neutrality in that effort. The City's campaign was not fair and neutral. The City was not content to simply present the facts. The exhortations urging citizens to vote based on the dire consequences of the failure to do so were so one-sided and overdramatized that voters were left v ith no reasonable alternative besides voting for the measure. The City used public funds and public resources to advocate one side of a controversial issue without affording opponents the opportunity to present their side using the 00196-Koopman and Johnson et a1 v. City of Bozeman et aI COIYPLAINT -PAGE 3 OF 2S same resources. The City's one-sided promotional effort was so brazen and contemptuous it violated the law. Consequently. the Plaintiffs seek a declaration that interpretation of statute the City relied on is incorrect as a matter of law. The City impacted the rights of the Plaintiffs during the entire course of the election. Voters have a right to expect and receive fair and impartial elections untainted by any government intrusions. The election is voidable due to the acts of the City. The Court should prohibit the certification of the election results. The City should be prohibited from issuing bonds based on the results of the election. 11, FACTUAL ALLEGATIONS A. Introduction 1. Plaintiffs, petition this court for Declaratory Action of Judgement,pursuant to MCA 27-8-101, et seq. to determine whether Defendants,, CITE' OF BOZEMAN ("Bozeman"), its commissioners and its public employees violated I4CA § 2-2-121, MCA § 13-35-226 or MCA § 13-37-210 or other Montana law, and affected Plaintiff's rights. 2. Defendants had a clear duty to use public funds and resources in compliance with Montana law. (City of Bozeman Charter Article V. Sections 3 and 4; and MCA § 2-2- 103). 3. MCA § 2-2-121 prohibits the use of public time, facilities,persoruleI or foods to support any political committee or the passage of a ballot issue, which includes a bond. 4. MCA § 13-35-226(4) is a similar prohibition contained in Montana's campaign laws. B Bond fnitiative 5. The Bozeman City commission voted unanimously to put a 20-year general obligation bond for a$36.9 million-dollar public safety building on the November 6, 2018 election ballot. 00 1 96-Koopman and Johnson et al v. Immediately prior to and during the time of the election, constructing a public safety facility police headquarters, a fire station,municipal courts and victim services was a primary City government objective, and City commissioner, officials and public employees were proponents of the construction of a public safety facility. 7. Bond measures to construct public safety facilities were defeated at two previous elections, and the subject remains controversial. 8. In a July 24, 2018 article by the Bozeman Daily Chronicle, City commissioners and other officials took the position_ that they needed to "sell"the bond issue question to voters to urge support for its passage. 9. While debating the adoption of the ballot language,the City commissioners stated their support for passing the bond measure and were obviously proponents of the effort. W. In Tune 2018. the City Commissioners approved spending $8,000 to pay for the estimated cost of getting the bond issue on the ballot. 11. To the best of the knowledge and belief of the Plaintiffs, the City and its officials approved and authorized at Ieast another $6 7.600 relating to the bond measure Nvitl,out following appropriate procedures. C. Political Committees 12. On June 22. 2018, Defendants forined an incidental political committee and fled the required statement of organization with the Montana Commissioner of Political Practices (CoPP) (See,Exhibit"A"). The political committee name is "City of Bozeman." The Committee's address is the City's address. The treasurer is the City Control_Ier of the Finance Department. The phone number provided belongs to the City, and the treasure provided his City email address. 00 1 96-Koopman and Johnson et al v. City of Bozeman et al COA IPLAIINTT -PAGE 5 of 28 D. The states purpose of Bozeman's political committee is to inform the public of the impact of passage or failure of the bond issue on Bozeman operations. 14. The City of Bozeman spent at least$67,616.36, according to these incidental committee reports. 15. Included in this amount, the City's spent at least$30,664.07 on services provided by The Nest Collective(Nest). 16. According to invoices from Nest; contained in the City of Bozeman's political committee reports; City of Bozeman officials and public employees began having meeting with Nest to discuss promoting the bond measure in Miay of 2018, if not sooner. 17. "Team" meetings between City officials and employees and Nest were numerous and continued throughout the campaign. 18. According to these same reports.. the City paid Nest to develop talking paints, with"good words" for"tough g&a",post cards, banners, r'lyers, mailers, and other items typically used in paid political campaigns. Nest also developed presentations, a PR and "branding" strategy, website, logo, op-eds, and paid ads for newspapers, TV, radio, social media, digital campaigning,including production. photography, and organizing general internal team strategy meetings. 19. From September 28 to October 20 the City of Bozeman used at least$32,987.66 of staff time on bond campaign efforts. 20. The City of Bozeman, through its officials and public employees, also created a principal ballot issue cornmittee a month before the election. (Exhibit`B" C-2, Statement of Organization for Bozeman Citizens for Safety (BCFS)). 21. BCFS filed as a political committee on October 5. 2018. 00 1 96-Koopman and Johnson et al v. City of Bozeman et al COMPLAfNIT -PAGE 6 OF 28 22. Two of the three individuals on the BCFS C-2 are with the City of Bozeman—Terry Cunningham (Additional Officer) and Chris Mehl (Deputy Treasurer). 23. The BCFS political committee even classified itself as a subtype "City"on the required organizational C-2 form. 24. Terry Cunningham is a Bozeman City commissioner and Chris MeW is a commissioner and the Deputy Mayor. 25. The Committee is fwided by an $800 loan from Chris Mehl, Deputy Mayor(shown as "City's Policy Director" on the report), and individual contributions from the Mayor, other city commissioners, the Deputy City Manager, the City Manager, and a City Fireman. 26. Seven(7) of its nine (9) contributors to the BCFS are either city commissioners or public employees. The eighth (8th) contributor is an association entirely made up of public employees. 27. BCFS and the City utilize Headwaters Economics, an entity and facility under control of Deputy Mayor Mehl to conduct political committee activity%and distribute political materials. 28. The Defendants' conduct was also prohibited by MCA § 13-35-226(4). Defendants conduct was advocacy rather than educational, was not properly incidental to their normal activities and supports both the passage of the bond and a political committee specifically organized to support the bond. 29. The political committees created by the Defendants are entirely or substantially comprised of public employees who are either contributors to or officers of the political 00I96-Koopman and Johnson et a] v. City of Bozeman et a]COhZPLAINT -PAGE 7 OF 28 committees so Defendants' political committee, Bozeman Citizens for Safety, violates MCA § 13-37-210. 30. According to the reports these political committees submitted, the Defendants coordinated their activity and used public funds and public resources to support passing the bond and BCFS. Ill. PARTIES 31. Plaintiff Roger Koopman is a Montana citizen and resident of the Bozeman, Gallatin County, Montana. Mr. Koopman is a registered voter and pays taxes in Bozeman and his taxes «rill increase if the bond issue passes. Mr. Koopman actively engages in efforts promoting responsible government. 32. Plaintiff Paul F. Johnson is a Montana citizen and resident of the Gallatin County, Montana. heir. Johnson is a registered voter and pays taxes in Bozeman and her taxes will increase if the bond issue passes. Mir. Johnson owns a business in the City of Bozeman. Montana. He opposed the bond but was unable to vote against it due to the manner in Which the City placed it on the ballot despite his owning a business with property that pays City taxes and contributes revenues to the City thereby affecting Mr. Johnson. 33. Plaintiff DOES 1-5 are area City or residents who pay taxes to the City of Bozeman's for its general operations. DOES 1-5 reT on City officials to conduct business on behalf of the general public according to their public duty. DOES 1-5 suffers harm when public employees and public resources are dedicated to political advocacy rather than public services. 00196-Koopman and Johnson et al v.City of Bozeman et a] COMPLfiNT -PAGE 8 OF 28 34. Defendant City of Bozeman (City)is a political subdivision of the State of Montana located in Gallatin County,Montana. 35. Defendant Cyndy Andrus is a city commissioner and the Mayor of Bozeman. She resides in Bozeman. She has a duty to the Plaintiffs and DOES 1-5 to use public funds and perform the functions of her office according to Montana lain. Mayor Andrus is a contributor to the BUS political committee. She attends "team meetings" and meetings that include BCFS where campaign decisions were made, and funds were expended. She worked in coordination with the City, other City and BUS officials, Nest, and she made other decisions critical to the operation of both committees. Mayor Andrus, using her official title; wrote an editorial (Op-ed) which appeared in the local paper just prior to the vote reciting the campaign slogan "Bozeman is the safest large city in Montana. Let's keep it that way and pass a bond to build a new Public Safety Center." Again, Bozeman is safe, let's keep it that way, and pass (vote for) the bond. 36. Defendants Chris Mehl (Deputy Mayor)Jeff Krauss, and Terry Cunningham are city commissioners and reside in Bozeman. Individually, and acting together, they have duties and obligations similar to that of Mayor Andrus. These com_rnissioners also contributed to the Bozeman Citizens for Safety political conunittee, and to the best of Plaintiffs' knowledge attended the committee's meetings and participate in committee decisions and participated in other "team meetings"with or without Nest. 37. Defendant Pomeroy is also a city commissioner«Tith similar duties and obligations. To the best of Plaintiffs` knowledge and belief she approved of the spending, attended team meetings and was involved in other efforts related to promoting the passage of the bond issue. 00196-Koopman and Johnson et al v. City of Bozeman et al COMPL FAIT -PAGE 9 OF 28 3 S. Defendant Nest Collective, LLC ("Nest") is a Montana business entity headquartered in Bozeman; Montana. To the best of Plaintiff's belief and understanding, Nest contracted with Bozeman to develop and execute an educational campaign but is now conducting an advocacy campaign. By legal definition..Nest became a public employee when it entered into a contract with the City of Bozeman as an independent contractor. Among many other tasks, Nest was paid with City funds to develop the messaging, slogan and logo used by the committees, and it�ATas paid to prepare op-eds like the one Mayor Andrus placed in the local newspaper just prior to the vote. Nest worked in coordination with the City. City and BCFS officials,public employees, and made other decisions critical to the operation of both committees. 39. Defendants John and Jane Does 1 through 30 are public officials and employees of the City ofBozeman who were active`y involved in the City, s advocacy efforts supporting the bond and the political committee. With particularity, they are any and all public employees contained on any of the campaign finance reports filed with CoPP. >y7, JURISDrCTION, AND VENUE 40. This Court has jurisdiction of a proceeding for declaratory relief under the Uniform Declaratory Judgments Act. §§ 27-8-101, et. seq., seeking an interpretation of statutes, or sections thereof. within the laws of Montana, and in particular-MCA Secs. 2-2-121 and 13-35-226. 41. This Court has personal jurisdiction over the Defendant as officers and employees of the City of Bozeman. and the claims contained herein are brought against them in their official capacity as Bozeman government and staff. 00 1 96-Koopman and Johnson et a] v. The Court also has jurisdiction pursuant to Title 13 Elections, specifically § 13-35-107, MCA, specifically granting the court authority to void an election for violation of the statutory provisions under the same. 43. Venue is proper because the events giving rise to this Complaint occurred in Bozeman, Montana; Defendant City of Bozeman is a municipal corporation in Gallatin County: and all material witnesses are in Gallatin County, Montana. See,Mont. Code Ann. §§ 25-2- 125. 126. The officials and public employees work and reside in Bozeman, MT or within Gallatin County. 44. Plaintiff and John and Jane Doe Plaintiffs reside in Gallatin County and all activity or planned activity occurs there. 45. Bozeman is a political subdivision of the State of Montana. 46. The Defendants' actions are subject to court review under the Uniform Declaratory Judgments Act because Plaintiffs) seek a declaration from the court that MCA Secs. 2-2- 121 and 13-35-226 prohibit Bozeman from engaging in the described conduct, and the conduct affects statutory rights belonging to and protecting the Plaintiff(s) from such conduct. See. Mont. Code Ann. §§ 27-8-101. et. Seq. The Defendants' interpretations. or any advice they received in reaching them is incorrect as a matter of law. 4T The Defendants' violations probably affected the outcome of the election the election is invalid pursuant to Ir/1CA 13-35-107. CLAIM GNTE. DECLARATORY JUDGEMENT 48. Plaintiffs hereby incorporate by reference each statement and allegation previously made. 00196-Koopman and Johnson et al v. The Montana Declaratory Judgement Act is designed to settle and provide relief from uncertainty and any insecurity with respect to rights, statutes, and other legal relations. MCA § 27-8-102. 50. The Montana Declaratory Judgements Act is liberally construed and administered. MCA § 27-8-102. 51. Any person whose rights, status, or legal relations are affected by a statute, municipal ordinance, or franchise may have a court determined any question of construction or validity arising under the instrument, statute,ordinance, contract or franchise and obtain a declaration of right, status, or legal relations. See, MCA § 27-8-202. 52. plaintiffs are entitled to have their rights adjudicated and to have the Court interpret the application and meaning of MCA § 2-2-121, § I3-35-226, and § 13 7-210, including the legal question of whether the Defendants violated the law when engaging in campaign expenditures and coordinated efforts in support of a bond measure submitted to the electorate using public funds, staff, facilities, and other public resources. 53. The overlap between the people who voted to place the bond measure on the ballot. and the tv,7o ballot issue committees was so overt that it resulted in unavoidable coordination. According to the reports filed and the activities observed, each entity and their-agents worked in cooperation with one another at the direction or request of public officials or Nest with express prior consent and understanding. 54. Forming even one of two political committees demonstrates the City's clear intent to advocate support for the measure since it is unnecessary to register a political corninittee that only engages in neutral educational efforts. OO 196-Koopnan and Johnson et al v. City of Bozeman et a]COMPLAINT -PAGE 1?0F2S 55. The City, and its commissioners and employees spent public time and funds directly and created and supported a political committee. 56. The City, with the commissioners approval, engaged the professional commercial services of Nest to facilitate these efforts that was nothing short of well-orchestrated political campaign. Everything that was done to mount by the City and Nest was exactly what a traditional political campaign would have done. 57. Engaging services in this way resulted in Nest and its staff becoming public. employees. 58. The unmistakable and coordinated efforts of the two committees contain political messages that were advocacy or the functional equivalency of advocacy. The only way a recipient of the message could "Keep Bozeman Safe" was to "Vote on November 6'"'. No alternative was offered. No alternatives were provided. 59. A mailing titled "Bozeman Public Safety Center Bond Facts" indicates supporting the bond measure as a"solution"the City of Bozeman "needs." Recipients were told they must act"now." The only way to act "now" was to vote. 60. Bozeman spent public funds or, digital advertising through several commercial mediums, The advertisements state "Vote Nov. 6" with an arrow pointing to "Bozeman Public Safety Center." (See; Exhibit "C"). The context of the word "vote"together with the directional symbol constitute express advocacy, which clearly exceed the exception provided, in MCA § 2-2-121. 61. Slogans and messaging were the functional equivalent of advocacy. There was no other susceptible meaning one could derive from the conununication other than to vote and any person reading.. or hearing, it would clearly know they were being urged to "vote for" the bond because that was the only thing they can do to "Keep Bozeman Safe." 00196-Koopman and 3ohnson et al v. The court and agency decisions demonstrate that Bozeman operated outside the parameters of the limited educational exclusion and engaged in advocacy. 63. Bozeman hosted, and public employees presented, this advocacy message at numerous townhalls and other events. 64. Plaintiff has reason to believe the Committee's yard signs and other election materials are stored in a common location with the City of Bozeman's materials. 65. The Plaintiff has reason to believe the public was directed on how to receive these materials on public property by public officials during hours of public employment. 66. The IViontana Declaratory Judgments Act entitles Plaintiffs to recover supplemental relief including costs and attorney's fees, as a result of bringing this action. MCA § 27- 5-311 through 313. 67. Therefore, Plaintiffs are entitled to an award of attorney's fees and costs from the City of Bozeman as a result of Plaintiffs being forced to prosecute this legal action. 69. As Claims Two through Seven further show PIaintiffs are entitled to a declaration and relief. CLAIM TWO. N710L.,ATION OF rACA § 2-2-121 MULES 0lj CONDUCT FOR PUBLIC OFFICERS AND PUBLIC EMPLOYEES 69. Plaintiffs hereby incorporate by reference each statement and allegation previously made. 70. A public officer or employee may not use public time, facilities or personnel or funds to solicit support for a political committee or the passage of a ballot issue.. which includes a bond, unless the activity is properly incidental to another activity "required or authorized by law" such as a function performed in the normal course of duties. MCA § 2-2-121(3). 71. Supporting a bond issue is not required. 00196-Koopman and Jolmson et al v. City of Bozeman et al COMPLAINT -PAGE 14 OF 28 72. Supporting a bond issue is not specifically authorized by law, in fact, it is expressly prohibited. 73. MCA § 2-2-12 1(3)(b) further restricts Defendants by defining the phrase "properly incidental activities"to activities by a public officer(or staff) "related to determining the impact of the passage or failure"of the bond on local goverinnent operations. 74. A typical example of an exempt incidental activity would be the impact passage of the bond has on an individual taxpayer, since the information is pertinent and usually requested by both sides during an election. 75. Defendants' interpretation of the statute is legally absurd because it renders the statute meaningless. 76. The Montana Legislature set policy to generally prohibit political czanpaig wing by government. 7T The educational exemption incidental' to the normal operations of go veriinient was provided so that goNienzments could educate the public about the impacts the measure's passage or failure is likely to have on govemmnent operations—not the community at large—and so officials could respond to public and media inquiries. 78. In creating the exemption to the general policy, the Legislature did not intend to establish a loophole that results in a NN-ell-orchestrated political campaign with a $70,000 plus budget using paid political consultants, ad buys and production,messaging, logos, branding; slogans, flyers, mailers, t-shirts, buttons. stickers, banners,posters. outreach, and online videos together with 30 public employees urging voters to support passing the bond. 00 1 96-Koopman and Johnson et a]v. City of Bozeman et a]COMPLAINT -PAGE 15 OF 28 79. Orchestrated campaigns, educational or otherwise, are not activities performed as a fiinction in the norinal course of their duties. 80. The Defendants, in their capacity as elected officials, were legally precluded from using public resources to support a political committee—but, they started, supported and controlled two. 81. A government official or employee does not relinquish First Amendment rights enjoyed by other citizens because of their public status so long as they are not using public time, facilities, equipment, supplies,personnel, or funds to engage in their political speech. 82. On June 22, 2018, Defendants fled an incidental political committee with the Montana Commissioner of Political Practices (Exhibit "A''). The political conunittee name is "City of Bozeman." The address is the City's. The treasurer is the City Controller of the Finance Department. The phone number provided belongs to Bozeman, and the treasurer provided his City-email address. 83. The City of Bozeman reported expenditures for"messaging and op eds (opinion editorials)"and "strategy phone calls with Cyndy (Mayor Andrus)."Or November 4. 2018. Mayor Cyndv A-ndrus published an opinion editorial under her official title urging voters to "pass a bond" and "voting yes." 84. The stated purpose of City`s incidental political committee on the C-2 is to inform the public of the impact of passage or failure of the bond issue on City`s operations, and the City does not stay within the scope of this supposedly intended purpose. 85. As previously mentioned,if the City was engaged in a purely permissible activity, which has a specific Iegal exemption, there ivas no justifiable reason to farm this political committee. 001 96-Koopman and Johnson et a]v. City of Bozeman et al COMPLAINT -PAGE 16 OF 28 86. The COPP specifically excluded any normal communications by a local government that includes inforrnation about a ballot issue. (ARM 44.11.605(3)(d)). 87. The City, through its officials and employees, also created a principal ballot issue committee a month before the election. (Exhibit"C" C-2, Statement of Organization for Bozeman Citizens for Safety(BCFS)). 88. BCFS is made up entirely of City officials, with one exception, former Mayor Carson Taylor, employed by the City until January 2018. The committee selected"City"in classifying its committee subtype on reporting forms. 89. The Committee is funded by an $800 loan from the Deputy Mayor, and individual contributions from the Mayor, City Commissioners; Depute City Manager. City Manager., and a City Fireman. The Committee has not received any funding other than individuals employed by the City. 90. Seven (7) of its nine(9) contributors to the BCS are either city commissioners or public employees. The eighth (8t1i) contributor is an association entirely made up of public employees. 91. These two political committees, established by the Defendants, worked in concert, to support the passage of the bond. Their efforts were facilitated by a shared political consultant and shared office space at Commissioner Mehl's place of business. Headwater Economics. 92. The shared political consultant, Nest, is, by legal definition, a public employee if its services were engaged by the City to oversee the activities of the City's incidental committee and educational campaign. 00 1 96-Koopman and Johnson et a]v. City of Bozeman et a]COMPLAINT -PAGE ]1 OF 28 93. As of October 25,2018, Bozeman, through its incidental committee reported spending $67,616.36 on bond related activity. 94. Of that amount $30,664.07 went to Nest for project management and production for"PR, name, logo and branding", as well as "team meetings", which included public officials and employees to discuss budgeting, public outreach and perceptions, communications regarding "messaging" and "op-eds", logo,post cards,posters and banners (including design, approval, delivery and placement), button and sticker design, compliance with disclaimer provisions. materials (including PPT, Q&A and talking points), social media ads, technical support, online videos, TV proposal/production, statement stuffers to include with utility bills, digital banners and ads. (Exhibit "M City C-4s). 95. Public officials and public employees spent time and were compensated by the City for team meetings with Nest, outreach, attending events, snaking presentations. calls to "prospective groups"to arrange presentations.. preparing op-eds, and numerous other promotional activities. (Exhibit "D" City C-4s), 96. The City staff time for bond campaign_related activities totals $31,917.50 to date. 97. The Bozeman Citizens for Safety uses the logo and branding work developed for the City by Nest. it's indistinguishable. The messaging and slogans were the same. Each was the functional equivalent of an election conununication. 98. The City of Bozeman's campaign materials depict an arrow pointing from "vote"to "Bozeman Public Safety Center." The use of an arrow unmistakably connects vote to Bozeman Public Safety Center. This constitutes an express message to the public to vote for the Bozeman Public Safety Center. See, Exhibit "C". 00 1 96-Koopman and Johnson et al v. City of Bozeman et al COMPLAINT -PAGE 18 OF 28 99. The slogan "KEEP BOZEMAN SAFE" was indistinguishable and the functional equivalent of the slogan`BOZEMAN IS SAFE. LET'S KEEP IT THAT WAY, and VOTE." 100. The Logo, branding, colors layout design, graphs, font and general messaging was the same. Not surprisingly, the Bozeman Citizens for Safety shows no expenditures for message development, a logo, branding, and graphic design. 101. Previous CoPP cases have considered whether Iocal government activity constituted a "communication advocating the success"of a ballot issue. The threshold question is whether an expenditure expressly advocated support or opposition. 102. _FEC v. If'is. Rig it to Life is still instructional as to whether a cominunication is educational or advocacy. Ads which are susceptible of no reasonable interpretation other than as an appeal to vote for a clearly identified [ballot issue] is the functional equivalent of advocacy and it is not merely educational. 103. A person reading the material presented by the Defendants was not given neutral information that lacked an appeal to favor the Defendants' position. 04. In fact. after-reading the Defendants' material or hearing their presentations a recipient could have only concluded a contrary opinion, should they venture to have one. teas entirely unreasonable., derelict and entirely UNSAFE. 105, Unlike other ads the Defendants' ads and coznmunications clearly and uninistakably urged the reader, listener or view to Keep Bozeman Safe, and the only way they could do that was by voting. The only way to vote was in favor or a person was most certainly being urged to vote that way. 00 1 96-Koopman and Johnson et al v. City of Bozeman et al COMPLAINT -PAGE 19 OF 28 106.The question in other CoPP decisions was whether actions by local government officials and employees resulted in their becoming a political coimnittee, but Bozeman officials voluntarily filed as one. 10T When Bozeman orchestrated its campaign, it went well beyond merely explaining its rationale for making the request, which required it to create a political committee. 108.Because BCFS is an entity it can only act through its appointed agents (MT CoPP Braden at pp. 5-6). BCFS was clearly controlled by City officials and public employees and any BCFS act was an action taken and controlled by City officials and public employees. 109.Since BCFS uses the logo, branding, slogan, graphic design and benefitted from all the related consulting done by best for the City, which means the City made in-kind contributions to BCFS. 110.The City is legally prohibited from supporting political committees, as are Cite officials and employees. 111.The City and BCFS coordinated all their activity by acting in cooperation and consultation with one another. The actions were taken at the request of and with the express prior consent of each political c,^,r:mittee`s agents. ��hich«were then further facilitated by Nest. 112.AIl the agents, and Nest, were public employees. 113).Plaintiff has reason to believe these same agents intentionally. or unintentionally. created other political committees to facilitate its promotional political objectives. 114.This sort of coordination results in contributions to support the passage of a ballot issue or a political comt-nittee by public employees, which is expressly forbidden in MCA § 2-2- 121. 00 1 96-Koopman and Johnson et al v. City of Bozeman et a] COMPLAI?IT -PAGE 20 OF 28 CLAIM THREE: BOZENMAN VIOLATED § 13-35-226(4) PUBLIC EMPLOYEE ETHICAL STANDARDS 115. Plaintiffs hereby incorporate by reference each statement and allegation previously made. 116. A public employee may not solicit support for or opposition to any political committee ... or the passage of a ballot issue while on the job or at the place of employment. Mont. Code Ann. § 13-35-226 (4). 117. By its plain language, this statute applies to the conduct of"public employees."The definition of the terni "public employee"is found in the Code of Ethics and refers to "any temporary or permanent employee of a local government.: § 2-2-102(7)(b), MCA; see also § 13-35-226 (4), MCA (citing Code of Ethics). 118 NTest is,by legal defmition., a public employee. 119. The definition of a"ballot issue"includes bond issue questions. § 13-1-101(6)(a),MCA. 120. The ethics statute precludes public employees from using public time or resources in the presentation or furtherance of political speech. § 13-35-226(4), MCA, see also, 2005 Mont. Atty. General Op. 51-0i (Jan. 31. 20051 (analyzing§ 2-2-121(3)(a)-(e), MCA). 121. A public facility bond proposal, such as the one put forth by Bozeman, is a ballot issue under- § 13-1-101(6)(a), MCA, and thus materials or activities which advocated for or against the passage of the bond would fit within the meaning of§ 13-3 5-226(4), MCA. 122. Materials advocating for the passage of the bond were present on Bozeman property. 123.However., Bozeman informed Plaintiff that he ,N as prohibited from placing a simple opposing passage of the bond on the same City properties. 124. Bozeman expended public funds and public time in relation to Bozeman and BCFS materials. 00 1 96-Koopman and Johnson et al v. On,of Bozeman et al COMPLAINT -P AGE 21 OF 28 125. Bozeman public employees funded BUS advocacy materials. 126. Bozeman's public employees verbally advocated for passage of the bond in the media and at public events. 127. In doing so. Bozeman violated § 13-35-226(4) in the same way Defendants violated § 2- 2-121(3),MCA (as described in Claim No. 2). CLAIM POUR— VIOLATION OF § I3-37-210, MCA NAMING AND LABELING OF POLITICAL COMMITTEES 12S.Plaintiffs hereby incorporate by reference each statement and allegation previously made. 129.§ 13-37-210.MCA requires any political committee filing a certification and organizational statement, such as BUS, shall "name and identify, itself in its organizational statement using a name or phrase (1) that clearly identifies the economic or other special interest, if identifiable, of a majority of its contributors. and (2) if a majority of its contributors share a common employer, that identifies the employer. 130.The name or phrase "Bozeman Citizens for Safety" does not clearly identify the economic or special interest identifiable by the public official contributors. I31.It does not name the "City of Bozeman" as the comiinon employer. 132.Consequently, eight of the nine contributors are directly associated «rith the City as employees. 133.Because of the shared, common employer, Defendants were required to use a name or phrase that names and identifies Bozeman in its organizational statement. BCFS's C-2 did not do so. 001 96-Koopman and Johnson et al v. City of Bozeman et al COMPLAINT -PAGE 22 OF 28 D4.Because of the shared, common employer, Bozeman, BCFS was required to use a name or phrase that names and identifies Bozeman in its organizational statement. BCFS did not do so. 135. Therefore, Defendants violated § 13-37-210, by failing to satisfy legal mandates pursuant to Montana's naming and labeling of political committees' statute. . CLAIM FIVE: UNR.EPORTED COORDINATION AND COWRIBUTION 136.Plaintiffs hereby incorporate by reference each statement and allegation previously made. 137.The following example illustrates just one example of how City officials,employees and political committees coordinated activity and violated laves prohibiting advocacy and supporting political committees. 138.Defendants store and distribute campaign materials at Headwaters Economics. a corporate facility owned or controlled by Commissioner Mehl. the Deputy Mayor. 139.Commissioner Mehl is also one of three of the BCFS officers, 140.Though not reported. the use of the Head«rater Economics' facility is an in-kind contribution to the City and BCFS. 141.Deputy b/layoz/Commissioner h/eh`Fs coordination beVNN 7ecn lleadwater Economics. City and BCFS was illegal and improper. 142. BCFS's campaign finance reports indicate yard sign expenditures on August 23. 2018. 143.BCFS's October 10, 2018 report shov,,s expenditures the design of yard signs. 144. The City indicates numerous expenditures for banner design in August 2018. 145.The BCFS yard signs purchased in August 23, 2018 benefitted in-kind from the Cite of Bozeman's campaign expenditures. 00 1 96-Koopman and Johnson ei al v.City of Bozeman et al COMPLAINT -PAGE 23, of 28 146. The BCFS yard signs,purchased August 23,remarkably resemble the banners purchased by the City of Bozeman on August 22. 147."Coordinated", including any variations of the term,means made in cooperation�N ith, in consultation with, at the request of or with the express prior consent of a candidate or political committee or an agent of a candidate or political committee. Mont. Code Ann. § 13-1-101 (10). 148. A "coordinated expenditure" means any election communication, electioneering communication, or reportable election activity that is made by a person in cooperation with, in consultation with, under the control of, or at the direction of in concert with. at the request or suggestion of, or with the express prior consent of a candidate or an agent of the candidate. The coordination of an expenditure need not require agreement, cooperation, consultation, request, or consent on every term necessary for the particular coordinated expenditure, but only requires proof of one element, such as content, price, or timing, to be met as a fact of a coordinated expenditure. ARIM 44.11,602 (1). 149. When determining whether a cotnrnunication or reportable election activity is coordinated the following nhay be considered, whether it is based on lnfornhation that is provided indirectly to the person funding or facilitating the communication or activity. or any person involved in creating, producing, or dissefninating it. ARM 44.11.602 (2)(a). 150. "Contribution"means the receipt by a political committee of an advance, gift, loan, conveyance, deposit, payment, or distribution of money or anything of value to support or oppose a candidate or a ballot issue. h/lont. Code Ann. § 13-1-l01 (9)(a)(i). 00196-Koopman and Johnson et al v.City of Bozeman et al COMPLAINT -PAGE 24 OF 28 151. "Contribution" also means an expenditure; including an in-bind expenditure, that is made in coordination with a ballot issue committee and is reportable by the ballot issue committee as a contribution. Mont. Code Ann. § 13-1-101 (9)(a)(ii). 152. Headwater Economics coordination and contribution were and are reportable election activities because they fund and facilitate communication, activity, and dissemination of campaign materials on a ballot issue. 153.Headwater Economics similarly coordinated with two ballot issue committees in making an unreported in-kind expenditure. 154.Doing so amounts to illegal coordination vihich resulted in the City's support for the Bond issue and for at least two other-political committees. and this Court should so declare. CLAIM SIX-. ACTION TO 170 D BOND ELECTION RES LTS 155.Plaintiffs hereby incorporate by reference each statement and allegation previously made. 156.The bond election was held on November 6, 2018 and passed -vith a sufficient number of votes. 157. The City's unauthorized political advocacy and iiiegal intrusion or their other violations probably affected the outcome of the election. 158.When violations of MCA Tide 13 Elections "probably affected the outcome of any election," the judicial remedy is provided by § 13-35-10 7. 1v4CA. ("voiding Election"). 159. When"a court finds that the violation of anY provision of this title by any person probably affected the outcome of any election. the result of that election may be held void." MCA § 13-35-107 (1)(a) (emphasis added). 00 1 96-Koopman and Johnson et al v. City of Bozeman et al COMPLAINT -PAGr.25 of 28 160. As set forth above, Defendants violated several provisions of MCA Title 13 EIections. Including MCA §§ 13-35-226, 13-37-210, 13-35-204 (official misconduct a misdemeanor) and 13-37-207(10) (required to file sworn statement reports are true and correct). 161. Defendants violations are certain to affect the outcome of the election. 162. Plaintiffs present action is timely. See, § 13-35-107 (2), MCA. 163.The Court should also void the election because the City and its commissioners, officials and public employees violated MCA § 2-2-121 and other provisions of Montana law affecting the legal and constitutional rights of the Plaintiffs. 164. Therefore, the Court should void the result of the bond election. CLAIM SEVEN— PLAINTIFF IS ENTITLED TO ATTORNEYS FEES 165.Plaintiffs hereby incorporate by reference each statement and allegation previously made. 166.Plaintiff re-alleges all paragraphs hereinabove set forth and incorporates the same by reference as if fully set forth here in their entirety. 167.Plaintiff is per-mitted attorney fees under MCA § 27-8-31 1 and 313,, because costs and attorney- fees are hereby petitioned. and awarding costs and attorney fees are necessary or proper under the circumstances of this case. 168. Plaintiff is entitled to an award of attorne}rs' fees and costs under the private attorney general doctrine because this case vindicates important societal policies,protects the integrity of the Montana Constitution, protects the integrity of the electoral process, and requires private citizen enforcement while the magnitude of the resultant burden upon Plaintiff is great; and a large number of Montana citizens bene i t from the decision in this case. 00 1 96-Koopman and Johnson et a]v. REQUEST FOR RELIEF WHEREAS, declaratory relief against Defendants will resolve all issues with respect to this application for the reasons provided herein and will vindicate the rights of the Plaintiffs. WHEREFORE, Plaintiffs prays for the following relief- A. For a judgment declaring that the Defendants incorrectly interpreted Montana Iaw and violated the provisions of IVICA §§ 2-2-121, § 13-35-226(4), and §13-37-210, and engaged in advocacy to support the bond issue: B. For a judgment declaring the Defendants name for the BCFS political committee did not comply with Montana law and its activity was consequently not transparent; D. For a judgment declaring the Defendants' violations probably affected the outcome of the election: and, E. In turn, a court order voiding the bond election_results. F. For an award of costs and attorney fees pursuant to the authority of tire Uniform Declaratory Judgments Act, h/1ont. Code Ann. §§ 27-8-10I. et. seq. G. For other damages, costs, and attorney fees or relief as allowed by law or equity that the Court deems just.
