Said storm drain easement is depicted on Exhibit A attached hereto and more particularly described as: Beginning at the Southeast corner of Lot 1 and the easement herein described, being a point on the North right-of-way of Durston Road, from which point the quarter corner common to Sections 3 and 10, T2S, R5E, P.M.M., bears S 84' 38' 16" E, 665.13 feet, said point of beginning; Thence, from said point of beginning, N 88' 31' 02"W, 60.00 feet along the North right-of-way of Durston Road; Thence, N 020 18' 57" E, 30.00 feet; Thence, S 88' 31' 02" E, 40.00 feet; Thence, N 02' 18' 57" E, 40.00 feet; Thence, S 88' 31' 02" E, 19.99 feet to the East line of Lot 1; Thence, S 02' 18' 57" W, 70.01 feet along the East line of Lot 1 to the North right-of-way of Durston Road and to the point of beginning, and containing 2,600 sqft., more or less and as shown on Exhibit A. All improvements are the property of the CITY OF BOZEMAN, removable at its option. The failure of the CITY OF BOZEMAN to exercise any of its rights granted herein shall not be construed as a waiver or abandonment of the right. The CITY OF BOZEMAN agrees to hold Grantor harmless from any and all liability that may result or arise from the exercise of the rights granted hereby.
