AMENDMENT NO. 2 TO LICENSE AGREEMENT FOR
USE OF CITY PROPERTY BY THE TRUST FOR PUBLIC LAND
This Amendment No. 2 to the LICENSE AGREEMENT FOR USE OF CITY
PROPERTY BY THE TRUST FOR PUBLIC LAND dated December 24,2014 ("License
'�'Agreement") is made and entered into this_jD ' day ofL � , 2018,by and
between the CITY OF BOZEMAN,MONTANA,a self governing municipal corporation
organized and existing under its Charter and the laws of the State of Montana, 121 North Rouse
Street, Bozeman, Montana, with a mailing address of PO Box 1230, Bozeman, MT 59771
("City") and THE TRUST FOR PUBLIC LAND, a nonprofit California public benefit
corporation with mailing address of 1007 East Main Street, Suite 300, Bozeman, Montana 59715
("TPL"and together with the City the"Parties").
WHEREAS the License Agreement authorizes TPL to have access to certain property
(the"Park Property")owned by the City for the purposes of completing certain improvements to
the Park Property(as described in that MOU referred to in the License Agreement); and
WHEREAS the License Agreement expires on December 31, 2018, but may be extended
for such additional period of time as is mutually agreed to by the parties in writing; and
WHEREAS the parties anticipate that development work will continue on the Park
Property through at least late summer,2019,and that there may be some limited ongoing work
after that time.
In consideration of the mutual covenants and agreements herein contained, the receipt and
sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the License
Agreement as follows:
1. Extension of Term. The term of the License Agreement is extended to December 31,2019.
2. License Agreement Still Valid. Except as modified herein, the License Agreement shall
remain unchanged and in full force and effect. This Amendment may be executed in
counterparts.
