Approve the Final Plat for the University Crossing Minor SubdivisionCommission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Tom Rogers, Senior Planner SUBJECT: Approve the Final Plat for the University Crossing Minor Subdivision Final Plat, Application 18243, and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman upon review and approval by the City Attorney’s Office. MEETING DATE: January 14, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for the University Crossing Minor Subdivision Final Plat, Application 18243 and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman upon review and approval by the City Attorney’s Office. BACKGROUND: On November 17, 2017, the City Commission approved the findings of fact completing the preliminary plat approval to subdivide 3.0211 acres together with the required supplementary plans and information to create three commercial lot and an open space lot primarily used for storm water detention. The developer has applied for final plat review and approval. The preliminary plat was unanimously approved (5:0) by the City Commission on October 23, 2017. Staff has concluded that all terms and conditions of the preliminary plat approval have been met. An improvements agreement has been completed for the future installation of landscaping improvements. The appropriate financial guarantees have been received. §76-3-611(1), MCA, provides that the City Commission shall approve the plat only if: (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. Attached is a memorandum from Tom 16 Rogers, Senior Planner, stating the staff has concluded that all terms and conditions of the preliminary plat approval have been met. UNRESOLVED ISSUES: None determined at this time. ALTERNATIVES: 1) Approve the final plat as presented and recommended. 2) Deny the final plat. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. Attachments: Staff Memo Final Plat Findings of Fact Report compiled on January 3, 2019 17 MEMORANDUM ---------------------------------------------------------------------------------------------------------- TO: GREG SULLIVAN, CITY ATTORNEY ROBIN CROUGH, CITY CLERK FROM: TOM ROGERS, SENIOR PLANNER RE: FINAL PLAT REVIEW FOR THE UNIVERSITY CROSSING MINOR SUBDIVISION, PLANNING FILE NO. 18243 DATE: December 21, 2018 ---------------------------------------------------------------------------------------------------------- C&H Engineering and Surveying, Inc., on behalf of 19th Capital Group, LLC (Applicant), made application to the City of Bozeman Department of Community Development for Final Plat review and approval for the University Crossing Minor Subdivision, Phase 2 (which would create three commercial lots and a common open space lot for stormwater retention/detention. Attached is a copy of the Findings of Fact and Order. The Commission approved the Findings of Fact on November 17, 2017. A one year extension has been granted by the Director of Community Development. An Improvements Agreement is required for this subdivision for the following improvements: landscaping improvements. Based on the summary review provided below, the City Engineering Department and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the Final Plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, property owner association documents, improvements agreement, and a copy of the Findings of Fact and Order are attached for your review. The Community Development staff respectfully requests that you prepare City Attorney's Certificates using the attached original Platting Certificates as updated; approve the Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plats. A completed application was submitted to the Community Development Department on May 29, 2018, amended on December 11, 2018. Provisional completeness is granted subject to a revised Platting Certificate and a financial guarantee for landscape improvements. The 20- day (working days) review period for this final plat will initiate once the aforementioned items are received. 18 Page 2 of 2 The conditions of preliminary plat approval, which are pertinent to this minor subdivision and how they have been met, are described in the submittal materials. Note: The Community Development Department and Engineering Department have also reviewed the final plat application against the preliminary plat cited code provisions and found compliance with these code requirements. The Engineering Department has also reviewed and approved the “closure” of the final plat. The project is scheduled for consideration by the City Commission on January 14, 2019. Please let me know if this will not work.
