Conditionally Approve On-Premises All-Beverage License for Bozeman TaproomCommission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Ashlie Portnell, Licensing Clerk Laurae Clark, City Treasurer Kristin Donald, Finance Director SUBJECT: Conditional Approval of the All Beverage License for Bozeman Taproom for calendar year 2019. MEETING DATE: January 14, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Conditionally approve an All Beverage License for Bozeman Taproom at 101 N Rouse Ave, Bozeman, MT 59715 for Calendar year 2019. The Bozeman Taproom has been approved by the state for an all beverage retail alcohol license. The City Commission approved a modification to the Tap Room’s conditional use permit in March of 2017 to go from beer and wine to full beverage. They have complied with state laws and have completed the City’s application process as required. Based on the procedures for issuance of a state alcohol license, at the time of submission of this application the Tap Room did not have a state issued license. However, they provided the attached letter from the state outlining the required contingencies. The Commission’s approval of a license pursuant to Chapter 4 of the Bozeman Municipal Code will require the Tap Room to provide the City Treasurer a final copy of the state issued full beverage license prior to the issuance by the Treasurer of the City’s alcohol license. Upon presentation of the state license, the required condition will be met. BACKGROUND: Sec. 4.02.030. - City license required; application; license fees. A. No person shall manufacture or sell alcohol in the city, under the provisions of the Montana Alcoholic Beverage Code, or at all, without first procuring a license to do so from the city. B. The application shall be filed with the city clerk and presented for the consideration of the commission. The commission may, in its discretion, postpone any action for investigation or other good cause. The action of the commission with reference to the application shall be recorded in the meeting's minutes. C. If the application is rejected, the reasons must be noted in the minute entry, the applicant notified, and the tendered fee returned. D. License fees must be payable in advance and shall accompany the application therefore, whether original or renewal. All licenses under this article will expire at 12:00 midnight of 11 December 31, in the year for which such license is issued. In the event that a license is granted after June 30 of any year, the license fee will be one-half of the entire yearly license. FISCAL EFFECTS: Accept payments totaling $400.00 for 2019 license. ALTERNATIVES: As suggested by the City Commission.
