Public Comment – Members of the audience or their agent may be invited to present testimony or evidence. To be recognized, each person desiring to give testimony or evidence shall step forward and, after being recognized, give their name and address for the record. The presiding officer may establish a time frame for each public comment but in no case shall such timeframe be less than three (3) minutes per speaker. The presiding officer may lengthen or shorten the time allotted for public testimony. Dick Pale, 422 S 6th; Would like more information about the residential parking district petition submitted by the neighborhood. David Kack, 1107 Pinnacle Star Street; Wanted to update the commission about a new MSU shuttle project. This new shuttle will run from the stadium parking lot to various stops on campus and back. This will hopefully reduce the need to build more parking by increasing student usage of the largest lot available on campus. E. Action Items 1. Discuss/Approve/Deny Bozeman Parking Commission Resolution 2018- 07, A RESOLUTION OF THE BOZEMAN PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA, RECOMMENDING THE ADOPTION OF A POLICY REGULATING THE APPROVAL OF RESIDENTIAL ON-STREET DISABLED PARKING SPACES BY THE BOZEMAN PUBLIC WORKS DEPARTMENT. (Exhibit 2) Mr. Meece explained that he has been working with the City of Bozeman Public Works Department to create an administrative policy for use when responding to requests for an on-street disabled parking spot in a residential area. Commissioner Wiseman confirmed with Mr. Meece that citizens will have to renew spaces approved under this policy annually. Commissioner Egge asked if there is an estimate of cost to this policy. Mr. Meece responded that the only known cost is the installation of a sign and curb paint; approximately $150 per space. Commissioner Naumann asked about this policy would work in a residential parking permit district. Mr. Meece stated that in the residential parking permit districts vehicles parking in these spaces would also need a residential parking permit. Mr. Meece reminded the Parking Commission that they recently adopted a policy which discounts, by 50%, one residential parking permit purchased by a resident with a state issued disabled parking placard or license plate. Mayor Andrus asked what the significant changes the Public Works Department made to the draft policy. Mr. Meece explained that Public Works suggested the annual renewal. He also said they would like a signed statement of consent for the signage. Commissioner Egge asked who will be administrating this policy. Mr. Meece confirmed that the Public Works Department will be managing this program, as they have done for years. Chair Naumann confirmed that this type space will still be subject to the other public parking rules and laws. Commissioner Egge suggested updating the documentation on the City web site to direct people to public works for questions and concerns on this topic. Discuss modification of the ‘By-Laws’ of the Bozeman Parking Commission, creating an Administrative Review Board (Appeals) as required by Ordinance 2013 (under consideration by the Bozeman City Commission). (Exhibit 3) Mr. Meece pointed out the by-laws of this topic and how this would create a new level of review. Modifying from a municipal infraction to municipal violation allows more flexibility in the appeals process and creates an appeals board. Mr. Meece stated that the by-laws should read administrative appeals board and not committee. Chair Naumann asked about section 4 E to determine if it needs more clarification. Commissioner Egge asked about the board and the way it will be set up and the terms and board selection. He mentioned the previous discussion of having three members of the Parking Commission for a one year commitment. Chair Naumann points out that it is a time commitment to serve on this committee and that should be thought about when considering the appointment of the board. Commissioner Bryan asked how many appeals may come to this level of appeal process and to confirm that we can combine all the appeal reviews at one meeting. Chair Naumann stated that more process of review is beneficial. Mr. Meece pointed out that the Legal Department would come in and do training with the board and make suggestions on how to proceed with the review of facts. Mayor Andrus pointed out that in the past there was a board of appeals for the City Commission and it may be beneficial to look at it for guidance. Commissioner Wiseman asked if under City and State statues are we able to make these a violation without any further review. Commissioner Ness suggested having three volunteers for a year. It is not a black and white process and could benefit from a review board. Commissioner Egge asked about the record keeping/minutes of the appeals process. Chair Naumann asked Mr. Meece to partner the red line bylaws with the ordinance. Commissioner Egge suggested putting in a revision under sub items that the marketing and strategic planning committees be moved under the ad hoc committees. 4. Discuss revised framework for the creation of Parking Permit Districts. (Exhibit 4) Mr. Meece pointed out that the purpose of this frame work is to help facilitate a conversation on the proposal, and keep it moving forward. Once the board has a reached a good consensus, the next step would be review by the internal ‘parking strategy team’. Then, the revised proposal should be presented to the public through a variety of formats. The results of these public conversations should be considered in drafting a final proposal for submission to the City Commission. Chair Naumann clarified that this is process is specific to Strategy 19 of the Strategic Parking Management Plan. Commissioner Wiseman noted that the framework language doesn’t recognize that ‘campers’ are vehicles, and different from trailers. He also pointed out that ‘dissolution’ needs to be in the body of the framework, and not just the heading. Commissioner Bryan asked for clarification as to whether this framework is for existing petition/requests of parking districts or only in the future for new districts. Mr. Meece responded only the creation/expansion/dissolution of new districts. Mr. Meece pointed out that there is a minimum size requirement for creating a new district at this time. Commissioner Lloyd asked how many requests are pending to modify the current residential districts, or create a district. He also asked how a residential parking district and a parking permit district differ. Mr. Meece pointed out that there is one request that has moved to petition at this time. He has received inquiries from another half-dozen areas of the city. Mr. Meece stated that the new Parking Permit Districts allow more flexible management of a parking district than the existing residential parking permit districts. A goal would be to use the Parking Permit District framework for the creation of new districts, rather than continue to duplicate the existing residential parking permit districts. Commissioner Bryan clarified that in a parking permit district we are enabling others to park in a district not only residents of that district. Chair Naumann pointed out that for clarification we should get rid of the word neighborhood and exchange it for the word district to create a tool that can be applied to a variety of situations. Commissioner Wiseman asked if defining boundaries of any new districts is really part of this process, or should that come at a later date. Mr. Meece responded that delineating the boundaries of a new district should occur later, when the approved framework is being utilized to create a new district. Mayor Andrus pointed out that the frame work was initially from the City Commission when there was concern of the B3 district. Commissioner Egge stated that a draft public engagement plan should be part of finalizing the framework at the January meeting. Commissioner Bryan states her appreciation of the effort Mr. Meece has made to move the parking permit district frame work forward. Kathy Powell, 1215 South Third Ave; asked why it is not mentioned in the title of the framework that it only applies to new districts, not existing ones, and only as a footnote. 5. Discuss scheduling of 2018 Ethics training (complete by April 1, 2019); one hour during a meeting of the Bozeman Parking Commission. Mr. Meece explains that the Annual City Ethics training will need to be scheduled and completed by March 30, 2019. Chair Naumann suggested that we email times that work best for commission members and that we should allow a minimum of two hours for that meeting. F. Parking Program Manager Report (Exhibit 6) Mr. Meece Commented that one Parking Enforcement Officer due to injury sustained in a work related vehicle accident; likewise, one parking enforcement vehicle is not in service as a result as well. Mr. Meece pointed out that the City Commission will be discussing several parking related items on Monday Night (12/17/19). The second reading and consent of ordinance of 20-13, an update of the strategic parking management plan, and a resolution increasing the Cash-In-Lieu fee will be discussed. G. New Business. Commissioner Wiseman asked if Mr. Meece would like to comment on the public comment at the beginning of the meeting concerning the petition to extend the parking permit district. Mr. Meece stated that this petition will be brought to the attention of the Parking Commission in January and will follow the process that has been done in the past. Chair Naumann noted that there has been a recent change made around Cooper Park and it may be playing a role in the process as well. Commissioner Lloyd commented on the marketing committee and the Parking Garage usage. He pointed out how the recent changes of how to use the garage may need further clarification and signage. Commissioner Egge commented that at their 12/3/18 meeting, the City Commission amended Ordinance 2013 to require their approval for modification of the Temporary On Street Parking Permit guidelines. Mr. Meece clarifies that the City Commission actually left the Parking Commission approval authority but added that they would ‘review’ any changes made. Mayor Andrus is going to investigate which understanding is correct. H. Adjournment. The next Bozeman Parking Commission meeting will be held January 10, 2019, 7:30 am, at City Hall.
