RESOLUTION PC2012-02 A RESOLUTION OF THE PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA, THAT DEFINES HOW CASH-IN-LIEU FUNDS CAN BE SPENT. WHEREAS, pursuant to city Resolution 3803, the Bozeman Parking Commission"shall have all the power specified by Title 7, Chapter 14, Part 46 of the Montana Code Annotated;" and WHEREAS, Sect. 7-144621(5), MCA, gives the Bozeman Parking Commission, having been vested the authority by the Bozeman City Commission, the power "to do and perform any and all other acts and things necessary, convenient, desirable, or appropriate to carry out the provisions of this part;" and WHEREAS, Chapter 18.46.040.C.2.b. of the Bozeman Municipal Code authorizes the Parking Commission to "review and consider all requests for cash-in-lieu payments" in the B-3 district;" and WHEREAS, Chapter 18.46.040.C.2.c. of the Bozeman Municipal Code authorizes that"for each required parking space not provided, payment shall be made to the City Finance Department as specified by standard payment requirements established by the Parking Commission;" and NOW, THEREFORE, BE IT RESOLVED that cash-in-lieu payments shall be spent by the Parking Commission 1. to acquire additional parking spaces in the B-3 District and 2. to maintain, repair, resurface, and improve all parking assets in the B-3 District that are under the management of the Parking Commission. PASSED and adopted by the Parking Commission of the City of Bozeman, Montana, on first reading at a session held on the 9th day of May, 2012.
