Written notice of each such claim, dispute and other matter shall be promptly reported and copied to the OWNER 10.9.2. When functioning as interpreter under paragraphs 10.8 and 10.9.1, ENGINEER will not show partiality to OWNER or CONTRACTOR and will not be liable in connection with any interpretation or decision rendered in good faith in such capacity. The rendering of a decision by ENGINEER pursuant to paragraphs 10.8 and 10.9.1 with respect to any such claim, dispute or other matter will be a condition precedent to any exercise by OWNER or CONTRACTOR of such rights or remedies as either may otherwise have under the Contract Documents or by Laws or Regulations in respect of any such claim, dispute or other matter. 10.10. Article 4 - Basic Engineering Services. The following items shall be added to, or amended in, the Engineer's scope of work in Article 4: 1. Article 4.1 Pre-Design Investigation Phase: 4.1.6.10. Evaluate four alternatives for the existing Secondary Anaerobic Digester tank and roof system: . Leave the digester as a secondary digester and replace the existing steel floating cover with a new steel gasholder cover designed to provide a practical maximum amount of gas storage. . Leave the digester as a secondary digester and replace the existing steel floating cover with a new steel gasholder cover designed to provide an average amount of gas storage. . Convert the digester to a primary digester with sludge heating, mixing, and a new fixed concrete roof. . Convert the digester to a primary digester with sludge heating, mixing, and a new floating steel gasholder cover. 2. Article 4.2 Preliminary Design Phase: 4.2.5 Add the following facilities to the project scope to be included in the design plans and specifications in the project design phase: . Replacement of the existing secondary digester steel cover with a new fixed concrete roof. . Addition of two mechanical draft tube mixers in the existing secondary digester to convert it to a primary digester. Amendment No.1, Page 1 of 2 .. . Piping, electrical, and control system modifications in the digester and the digester control building to allow operation of both existing digesters as primary digesters. . Add a new primary scum pump station for the new primary clarifier. 4.2.5.1 The number of design drawing sheets is estimated to increase from 45 sheets to 51.5 sheets to accommodate the new facilities not included in the original scope of work. More specification sections (approximately 3) are required for the new facilities. II. Article 6 - Compensation for Engineering Services.
