HomeMy WebLinkAboutParking Resolution 2018-07 Recommending Policy Regulating the Approval of Residential On-Street Disabled Parking Spaces by the Public Works Department Page 1 of 2 BOZEMAN PARKING COMMISSION RESOLUTION 2018-07 A RESOLUTION OF THE BOZEMAN PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA, RECOMMENDING THE ADOPTION OF A POLICY REGULATING THE APPROVAL OF RESIDENTIAL ON-STREET DISABLED PARKING SPACES BY THE BOZEMAN PUBLIC WORKS DEPARTMENT. WHEREAS, an individual with a need based on disability may need to park near their residence to safely access their vehicle; and, WHEREAS, an accessible parking location may not be available to an individual with a disability without a parking location restricted to vehicles displaying disability plates or placards; and, WHEREAS, Bozeman City Code Sec. 36.04.560 indicates that a disabled parking stall may be designated on a public right-of-way; and, WHEREAS,the City of Bozeman currently does not have a formal policy on the process for application to have a disabled parking space designated near a residence,or what considerations should be made to approve or reject such an application; and, NOW,THEREFORE, BE IT RESOLVED that the Bozeman Parking Commission recommends that the City of Bozeman adopt a formal policy for the Public Works Department to establish and regulate the ability of a resident in Bozeman who owns and regularly parks at their residence a vehicle with a current disability license plate or disability placard to request that a disabled parking space be designated in front of that person's residence; and criteria for the approval or dismissal of an application to the City for this purpose, including: • That no such space be provided if reasonably accessible off-street parking exists at the requested location; • Consideration of length of validity of the disability permit granted by the State of Montana Motor Vehicles Division; • That disability parking signs are to be installed at the request of property owners; • That renters must provide a signed statement of consent from the property owner to have disability parking signs installed; • That if the person requiring a disability parking zone moves,or their certificate expires and is not reissued,the property owner shall be responsible for notifying the Public Works Department, in writing,that the disability parking zone is no longer needed; • And affirming that disability parking zones or stalls are not exclusive to any resident or property owner; • That any vehicle with a valid disability license plate or placard may park in a designated disabled parking space. Page 2 of 2 • No more than one (1)disabled on-street parking space, per street block face will be created through this policy. • The space created through this permit will be for a twelve month period, renewable for subsequent twelve month periods upon verification,from the requesting property owner,that the condition of need still exists; PASSED AND ADOPTED by the Parking Commission of the City of Bozeman, Montana, at a session held on the 13th day of December 2018.This resolutio s II become effective immediately.
