WHEREAS, an annexation staffreport has been prepared in accordance with the Commission's
goals and policies for annexation and was presentecl to the Commission on June 6, 2005; and
WHEREAS, a public hearing on the Petition for Annexation was duly noticed and hcld on June
6,2005;ancl
WHEREAS, no objections to said annexation were raised at the public hearing; and
WHEREAS, the City did not reccive any written protest from the real property owners ofthc arca
to be annexed; and
WHEREAS, on June 6, 2005, the Commission authorized ancl clirected staff, upon satisfaction
by the app 1 icant ofthe terms of approval, to prepare the necessary documents to proceed with the annexation
of this tract; and
WHEREAS, the provision of availablc services, including, but not limited to, rights-of-way,
casements, watcr rights or cash in lieu, waivers orprotcst against creation of STD's and water and sewer
hookup fees, to said tract is the subjcct of a written agreemcnt between the City and from Jane L. Schaaf
and Don H. Millcr, 5534 Stucky Road, Bozeman, MT 59718, Hope Luthcran Church, Lloyd Mielke,
. Presidcnt, 210 South Grand Avenuc, Bozeman, MT 59715, Paul Boylan Trust, Mildrcd Boylan, Trustee,
1201 Highland Blvd, Apt. C223, Bozeman, MT 59715, Shady Lane Ranch Limited Partnership, Thomas

Fink, Partner, 4399 South 19th Avenue, Bozeman, MT 59718, ancl Marshal and Luzann Bennett, 5532
. Stucky Road, Bozeman, MT 59718, record owners of the tract; and
WHEREAS, said tract is the subject ofa plat or Certificate of Survey, filed in the office of the
Gallatin County Clerk and Recorder's Office; and
WHEREAS, the Bozeman City Commission hereby fincls that the annexation of this non-
contiguous tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the
inhabitants of the non-contiguous tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 46, M.C.A., the following-
described property, which is non-contiguous to the municipal boundaries of the City of Bozcman, be
annexecl to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and
include such ". 235 acres of land, to wit:
A Tract ofland being Certificate ofSurvcy No. 2286, Lots 3 & 4 of Minor Subdivision
. No. 235, the Southeast One-Quarter of the Southeast One-Quarter of section 23
described on Film 115 page 3747, Tract 4 of Certificate of Survey 2532, and a portion
of South 19 Avenue, Located in the Northeast One-Quarter, thc Southeast One-Quarter
& the Southwest One-Quarter of Section 23, the Northwest One-Quarter and the
Southwest One-Quarter of Section 24, the Southeast One-Quarter of Section 14, and the
Southwest One-Quarter of Section 13, Township 2 South, Range 5 East, Principal
Meridian Montana, Gallatin County, Montana, and bcing more particularly describcd
as follows:

The effective date of this annexation is May 1,2006.
