HomeMy WebLinkAboutResolution 3911 Annexation of Tract 17,19 Homesites , ~ ~\.\l-- COMMISSION RESOLUTION NO. 3911 , A RESOLUTION OFTHE CITY COMMISSION OFTHE CITY OF BOZEMAN, MONTANA, PROVIDING FOR THE ANNEXATION OF A CERTAIN CONTIGUOUS TRACT OF LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS O'F THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACT. WHEREAS, the City of Bozeman received a request for annexation from L.A.S.T., LLC, owner of the tract, requesting the City Commission to extend the boundaries of thc City of Bozeman so as to include a certain contiguous tract ofland located at 907 & 915 North 17th Avenue; and WHEREAS, an annexation staff report has bccn prepared in accordance with the Commission's goals and policies for annexation and was provided to the Commission on August 1,2005; ancl WHEREAS, Commission Resolution No. 3814 was adopted by the City Commission on July 5, 2005, dcclaring it to be the intent of thc City of Bozcman to cxtend thc boundaries of saicl City so as to inelucle said contiguous tract within the corporate limits of thc City; and WHEREAS, a public hearing on Commission Resolution No. 3814 was duly noticed and held on August 1, 2005; and WHEREAS, on August 1,2005, the Commission authorized and directed stan: upon satisfaction by the applicant ofthc terms of approval, to prepare the necessary clocuments to proceed with the annexation of this tract in accordance with Commission Resolution No. 3814; ancl WHEREAS, thc provision of available services, including, but not limited to, rights-or-way, easements, water rights or cash in lieu, waivers of protest against creation of SIDs and water and sewer hookup fees, to said contiguous tract is the subjcct of a written agreement between the City and L.A.S.T., LLC., record owner of the tracts; and WHEREAS, said contiguous tracts arc the subject of a plat or Certificate of Survey, filed in the office of the Gallatin County Clerk and Recorder's Office; and WHEREAS, the Bozeman City Commission hereby finds that the annexation ofthis contiguous tract is in the best interests ofthe City of Bozeman and the inhabitants thereof and of the inhabitants ofthe contiguous tract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 43, MCA, the following- described propcrty, which is contiguous to the municipal boundaries of the City of Bozeman, be anncxed I111I1111111111111111111111111111111111111111111111111I ~~,~~?:~~p II Shelley Vance-Gallatin Co MT MISC 33 00 , .. to the City of Bozeman and that the boundaries of said City shall be extenclecl so as to embrace and inclucle such 3.1 acres ofland, to wit: That tracts 17 ancl19 of the homesite subdivision, Township 2 South, Rangc 5 East, of the SW quarter of Section l, Gallatin County, Montana, described as follows: commencing at the northwest comer of said tract 19, said point being on the east right- of-way of North 19th A venue; thence north 89010'52" east, azimuth 570.68 feet; thence south 00"39'23" east, azimuth 240.00 feet; thence south 89010'52" west, azimuth 570.83 feet; thence north 00037'21" west, azimuth 240.00 feet to the true point of beginning. Section 2 The effective date of this annexation is May 1, 2006. Section 3 Thc annexation ofthe above-described tract is subject to the tenus of the Agrecmcnt dated April 24,2006, by and between the City of Bozeman and L.A.S.T., LLC.
