Commission Memorandum
REPORT TO: Honorable Mayor and City Commission
FROM: Mitch Overton, Parks and Recreation Department Director Chuck Winn, Assistant City Manager
SUBJECT: Amendment No. 2 to License Agreement for Use of City Property by the
Trust for Public Land. Extending Current Agreement by One Year.
MEETING DATE: December 17, 2018
AGENDA ITEM TYPE: Consent
RECOMMENDED MOTION: I move to authorize the City Manager to sign Amendment No. 2
to the License Agreement between the City and The Trust for Public Land, which extends the current agreement for a term of one year to complete construction of the Story Mill Community Park Phase I.
BACKGROUND: On December 24, 2014 the City entered into a License Agreement for Use of
City Property with The Trust for Public Land. The current Agreement expires December 31,
2018. The Amendment will extend the License Agreement for a term of one year, to terminate December 31, 2019.
This agreement allows The Trust for Public Land to enter upon and manage park construction
activities for the Story Mill Community Park. While anticipated substantial completion of the
Park is scheduled for July 20, 2019, we are requesting the full year extension for any other minor projects that may need completed after the official opening of the Park in summer of 2019.
The one-year extension of this License Agreement has been mutually agreed upon by both City
Staff and Trust for Public Land Staff.
UNRESOLVED ISSUES: None, the agreement has worked well in its current form, only the extension is requested.
ALTERNATIVES: As recommended by Commission
FISCAL EFFECTS: The extension of the agreement has no fiscal effects upon the City.
