SUBJECT: Authorize the City Manager to sign the Reimbursement Agreement with
Northwestern Energy for relocation of existing power poles at Baxter Lane and North 27th Avenue.

RECOMMENDATION: Authorize the City Manager to sign the Reimbursement Agreement
with Northwestern Energy for relocation of existing power poles at Baxter Lane and North 27th Avenue.
BACKGROUND: Attached is a copy of the partially executed Reimbursement Agreement
with Northwestern Energy the relocation of power poles to accommodate the Baxter Lane
improvements project.
There were two existing power poles that conflicted with the improvements being installed on
Baxter Lane. As North 27th is extended north of Baxter, it will be a split facility with a median
matching the typical section that is in place south of Baxter. One of the conflicting poles was on
the approximate centerline of 27th in line with the future median, but it was not far enough north
to fall within the median. It was within the asphalt section of the intersection and had to be moved to the north. The other pole was on the west side of 27th at the intersection and fell within
the new pedestrian ramp.
The pole on the west side of the intersection was simply eliminated because it supported a
smaller power line and there was another existing pole nearby that could be tied into. The pole within the intersection carries very large transmission lines and the relocation places the new
pole out of line with the other poles in the area. Because of this, two new steel poles had to be
added to accomplish the relocation. In the intersection a 74 foot steel pole with a concrete
foundation was added in the future median of 27th (see attached photo). A second 80 foot direct
bury steel pole was needed east of the intersection to get back on the alignment with the transmission lines continuing towards 19th.

The estimated cost of the improvements is $291,305.00. The work is complete and they are
compiling their final costs. It appears those final costs will be approximately $30,000 less than
the estimate in the agreement. The City will only be billed actual costs not to exceed the
$291,305.00 specified in the agreement. The original award for the Baxter project was $4,147,364.00. Change order 1 has been processed with included a few additive items that have
come up during construction, but also included some large deductive items that were done to
reduce the overall contract amount below the budget. That change order made the current
contract amount $3,875,198.00, of which $336,294.00 was for water main installation leaving
$3,538,904.00 for the road work. This addition would raise that road work total to $3,830,209.00 if the entire agreement amount were to be used. The project budget for the road
work was $4,000,000 in the Arterial and Collector fund and the Street Impact Fee fund.

ALTERNATIVES: As suggested by the City Commission
FISCAL EFFECTS: Not to exceed $291,305.00 from the Street Impact Fee and Arterial and Collector District Funds.
