PUBLIC STREET AND UTILITIES EASEMENT 1 '(9 PACt'2136 rIlH KAGY ROAD Scenic Developers, Inc., a Montana corporation, GRANTOR, in consideration of receiving annexation to the City of Bozeman along with accompanying rights and privileges, and for other valuable consideration, receipt of which is hereby acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, P.O. Box 640, Bozeman, Montana 59771-0640, GRANTEE, a perpetual street and utility easement for thc use of the public, over, under, and across, a portion of Lot 1 A, Minor Subdivision No. 191 A, according to the plat thereof, on file and of rccord in the officc of the Clerk and Recorder, Gallatin County, Montana, and located in the Southeast Quarter of Section 14, Township 2 South, Range 5 East, ofP.M.M.. Said easement is a strip of land ofvariablc width, and more particularly shown and described on the attached Easement Exhibit, which is made a part of this document by this reference. (See attached easement exhibit.) The GRANTOR warrants that he is lawfully seized and possessed of the real property described above, that he has and that he will forever defend the title to this property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may pcaceably hold and enjoy the rights and privileges hercin granted without any interruption by the GRANTOR. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns ofthc parties hereto.
