PUBLIC ACCESS AND UTILITIES EASEMENT
WEST BABCOCK STREET
AND
MENDENHALL STREET
Steve McGough, of Bozeman, Montana, GRANTOR, in consideration of receiving annexation to
the City of Bozeman along with accompanying rights and privileges and for other valuable
consideration, receipt of which is hereby acknowledged, grants to the City of Bozeman, a
municipal corporation of the State of Montana, with offices at 411 East Main, PD_ Box 640,
Bozeman, Montana 59771-0640, GRANTEE, two (2) perpetual street and utility casements for
the use ofthe public, over, under, and across, two (2) strips ofland situated in Gallatin County,
Montana, being that part of a parcel of land on file and of record with the Gallatin County Clerk
and Recorder's office on Film 156 and Page 757 located in the Southeast Quarter ofthe
Northwest Quarter of Section 11, Township 2 South, Range 5 East, ofP.M.M_, and more
particularly described as follows:
Strip for Mendenhall Street
(1) Commencing at the centcr quarter comer of said Section 11; thence westerly
269 degrees 20 minutes 08 seconds, assumed azimuth from north 591 . 14 feet
along the south line of the Northwest Quarter of said Section 11; thence northerly
00 degrees 35 minutes 24 seconds, 795.02 feet to the point of beginning; thence
northerly 00 degrees 35 minutes 24 second azimuth 60.01 feet; thence easterly 89
degrees 20 minutes 08 seconds azimuth 260.89 feet; thence southerly] 80 degrees
33 minutes 24 seconds azimuth 60_01 feet; thcnce westerly 269 degrees 20
minutes 08 seconds azimuth 260.91 feet to the point of beginning.

(2) The south 45.00 feet ofthe parcel described on Film 156, Page 757, records of the
Gallatin County Clerk and Recorders Office.
The GRANTOR warrants that he is lawfully seized and possessed of the real property described
above, that he has and that he will forever defend the title to this property against the claims of
all persons.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, convenants, and provisions of this casement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.
