SUPPLEMENTAL AGREEMENT TO WESTLAKE/MARTINEN ANNEXATION AGREEMENT This Supplemental Agreement to the Westlake/Martinen Annexation Agreement of April 1, 1992 is made and entered into this ::Z.:Zhv"day Of,A>~r,'/ ' 1993 by and between the City of Bozeman, a municipal cotporation of the State of Montana with offices at 411 E. Main St., Bozeman, Montana 59771-0640, hereinafter referred to as "City", and George E. Westlake, 15008 S.E. Graham Rd., Vancouve r, Wash ington 98684 and Kay H. Mar tinen, 401 Sunny slope Rd., Yakima, Washington 98908, hereinafter referred to as "Landowners" . WHEREAS the parties have previously entered into an annexation agreement dated April 1, 1992 for the purpose of annexing a tract of land owned by the Landowners as descr ibed in that annexa tion agreement previously entered into by the parties on April 1, 1992 (hereinafter April 1 Agreement): and WHEREAS the Landowners are in the process of entering into a second annexation agreement with the City for the purpose of annexing additional property contiguous to that property described in the April 1 Agreement and as described in that second annexation agreement to be entered into between the parties: and WHEREAS in paragraphs 12a and 12b of the Apr il I Agreement the Landowners have previously dedicated easements or r ight-of-ways for adjacent roadway extensions consisting of 60 foot easements on Baxter Road and North 5th Avenue, all as described in Exhibit F and G attached to that Agreement: and WHEREAS the parties have agreed upon a different alignment of Baxter Road and the North 5th Avenue road all as described in that second annexation agreement to be entered into between the parties: and WHEREAS it is to the mutual benefit of the parties that Exhibits F and G referred to in the April 1 Agreement should not be filed of record, but instead Exhibit I attached hereto which is the new alignment of Baxter Road and North 5th Avenue as set forth in the second annexation agreement to be filed between the parties should be filed of record which will provide for more adequa te traffic circulation for development for the area. WITNESSETH In consideration of the mutual covenants and agreements herein contained, the parties hereto agree as follows: I. Recitals A. The above recitals are true and correct. 2. Dedication of roadway easement right-of-way. ,~ The Landowners do therefore dedicate the following easement or right-of-way for adjacent roadway extensions: A. A 60 foot wide easement or right-of-way for Baxter Road at the northern portion of the WestlakejMartinen tract and a 60 foot wide easement or right-of-way for the extension of North 5th Avenue at the eastern border of the WestlakejMartinen tract. The easement right-of-way for both roads is attached hereto and described as Exhibit I. 3. Agreement not to record easements. The parties to this agreement hereby further agree that those dedication of roadway easements or right-of-ways previously set forth in the April 1 Agreement as described in paragraph l2a and l2b as Exhibits F and G shall not be recorded, provided that the City may record the roadway easements set forth in paragraph 12a and l2b, Exhibits F and G of the original April 1, 1992 Annexation Agreement, if the easement described in Exhibit I attached hereto is not dedicated as a public street within 3 years from the date of th i s ag r e erne n t . The parties further agree that all other provisions of that WestlakejMartinen Annexation Agreement dated April l, 1992 shall remain in full force and effect with the sole exception of this supplemental agreement which only affects paragraph 12 a and l2b of said agreement of April 1, 1992.
