UTILITY TIE-ON AND ANNEXATION AGREEMENT
November 1972
FOR AND IN CONSIDERATION of permission to connect buildings
erected and to be erect,ed upon the premises hereinafter described
to the water and sewer systems of the city of Bozeman, Montafta'r~-"""'~--
the undersigned, REMCO, INC., a Utah corporation of 225 South 2nd
East, Salt Lake City, Utah 84111, for and on behalf of themselves,
their heirs, executors, administrators and successors in interest,
do hereby covenant, agree and consent to include the hereinafter
described property situate in the county of Gallatin, state of
Montana, within the city limits and boundaries of the city of
Bozeman, Montana, upon the request of the City Commission of the
city of Bozeman, to annex the same thereto.
A tract of land in the East one-half East one-half
(E~E~) of the Northwest one-quarter of the South-
east one-quarter (NW~SE~) of Section Eleven (11),
Township Two (2) South, Range Five (5) East,
Montana Principal Meridian, being more particularly
described as follows: Beginning at a point on the
North line of the Southeast one-quarter (SE~) of
said Section Eleven (11), said point being South
89024'00" West, a distance of 121.22 feet from the
North one-sixteenth of the Southeast one-quarter
(Nl/16SE~) of said Section Eleven (11); thence
South 0002'10" ~ast, a distance of 177.68 feet;
thence North 89 30'39" East, a distance of 120.70
feet; thence South 0007'48" West, a distance of
35.57 feet to a point on the northwesterly right
of way line of U. S. Highway 191, said point
being centerline station 358+48.95; thence South
42024'43" West on and along said Northwesterly
right of way a distance of 488.66 feet to the
centerline station 353+60.29; thence North 00
G2'34" vJest, a distance of 570.80 feet to a pOillC
on the North line of the Southeast one-quarter
(SE~) of said Section 11; thence North 89024'00"
East, on and along said North line, a distance of
209.38 feet to the point of beginning, said tract
contains 2.477 acres.
1. The undersigned further covenant and agree to con-
struct and install a cast iron water main and a vitrified tile
tile sanitary sewer main at their own expense to serve the

aforesaid described property, said water main and sanitary sewer
main to be constructed and installed to city of Bozeman specifi-
cations on right of way easement to be designated by the city of
Bozeman, and to comply with city of Bozeman building, plumbing,
electric and mechanical codes, including fees.
2. The undersigned further covenant and agree to deed.,,,,._..........~"""'"
that portion of the completed water main and sanitary sewer main
constructed on city of Bozeman right of way to the city of
Bozeman, to become a part of the city water and sanitary sewer
system and to be so maintained by the said city.
3. The undersigned further covenant and agree to pay to
the city of Bozeman, Montana, prior to making said connection to
the water system of the city of Bozeman, all regular connection
fees and costs which may be in effect at the time said connection
is made.

Enclosed herewith is a executed copy ot the Utility Tie-
On and Annexa.tion Agreement entered into by your firm with the
City of Bozeman.
This agreement has been approved by our City Commission
and the copy is tor your information and :file.
It has cane to my attention that you are also concerned
with the status of :fire protection :for your property at the
present time. Based upon Remco having entered into the Annexa-
tion Agreement with the City ot Bozeman. ve are prepared and will
provide tire protection to your property trom this date torward
notwithstanding the tact that annexation has not yet been
accomplished. Providing tire protection tor properties that are
contiguous with our corporate City and the owners ot which have
entered into annexation agreements conforms with current policy
ot the Bozeman City Commission.
