SUBJECT: Resolution 4961 authorizing Change Order No. 3 to the 5.3 Million Gallon
(MG) Water Storage Tank Project.
MEETING DATE: November 19, 2018

RECOMMENDATION: Approve Resolution 4961 authorizing Change Order No. 3 to the 5.3 MG Water Storage Tank Project.
BACKGROUND: Attached is a copy of resolution 4961 and change order number 3 for the
above referenced project. This change order includes four items. The first and largest change is
required because the existing main between the plant and Nash road found to be much deeper and
in a different horizontal location than anticipated. This required replacement of the new flow meter vault with a larger one and increased the installation costs. Also related to this item was additional large diameter piping that was needed to make the connection to the existing main in the revised
location. The final two item were requested by the plant staff. The first is to paint the exterior
exposed concrete on a new manhole being installed and the other is for the relocation of one
existing fence gate and installation of a second new one. Pages three through seven of the change order provide a short description of each of the items involved with this change along with additional cost information. Overall this change will increase the contract price by $70,068.80 and
increase the contract time by 22 days. The final recommended change in cost and time for these
items is reasonable and commensurate with the work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order increases the contract amount by $70,068.80
from $7,631,999.94 to $7,702,068.74.

COMMISSION RESOLUTION NO. 4961
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH
MONTANA CIVIL CONTRACTORS, INC., BELGRADE, MONTANA.
WHEREAS, the City Commission did, on the 10th day of April 2017, authorize award of
the bid for the City of Bozeman 5.3 MG Water Storage Tank project, to Montana Civil Contractors,
Inc., Belgrade, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such
alterations or modifications of the specifications and/or plans of the contract be made by resolution;
and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the
City of Bozeman, a municipal corporation, and Montana Civil Contractors, Inc., as contained in
Change Order No. 3, attached hereto, be and the same are hereby approved; and the City Manager is
hereby authorized and directed to execute the contract change order for and on behalf of the City;
and the City Clerk is authorized and directed to attest such signature.
