PUBLIC STREET AND UTILITY EASEMENT
GallaJin Center L,imited Partnership, GRANTORS, in consideration of $1,00 and for other and
valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a
municipal corporation of the State of Montana, with offices at 411 E, Main, Bozeman, Montana
59771-0640, GRANTEE, a perpetual street and utility casement for the usc of the public, in, through,
and across a strip ofland situated in Gallatin County, Montana, 45.00 feet \vide to be located on the
following described real property:
^ portion of Tract C-1A, Certificate of Survey 1979, located in Section 35, Township 1
South, Range 5 East, P,M,M" City of Bozcman, Gallatin County, MontamL
The easement is more particularly dcscribed on the attachcd Exhibit(s) A & B which by this
reference are made a part hereof.
The GRANTORS state that they possess the real propcrty described above and that they have
a lawful right to grant an easement thereon,
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR,
The terms, covenants, and provisions of this casement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto,

Range 5 East, P,M,M, City of Bozeman, Gallatin County, Montana, described as follows:
'fhe south line of a 45,00 foot wide public street and utility casement also being the ccnterline of
Baxtcr Road being more particularly described as follows and as shown on the attached Exhibit "B";
PARCEL 1
Beginning at the south one-quat1cr corner of said Section 35, TIS, R5E;
Thence along the south line of Section 35, North 89045'14" East, a distance of 820,00 feet to the
southwest corner of Tract C-IB, C,O,S, 1979 and the end of this easement;
The sidelines of said easemcnt being shortened or lcngthened so as to begin on the west line of Tract
C-1A and end on the west line of Tract C-1B;
PARCEL 2
Commencing at the southwest comer of Tract C-1 B, C.O,S, 1979, continuing along said south line
of Section 35 also being the south line of Tract C-1B, CO,S, 1979, North 89045'14" East, a distance
of 450.00 feet the southeast corner of Tract C-IB, CO,S. 1979 and thc Point of Beginning for
PARCEL 2;
Thence continuing along said south line of Section 35, North 89045'14" East, a distance of 398,59
