PUBLIC STREET EASEMENT
Gateway Limited Partners , GRANTOR, in consideration of $1,00 and for other and
valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a
municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana
59771-0640, GRANTEE, a perpetual street and utility easement for the use of the public, in, through,
and across a strip ofland situated in Gallatin County, Montana, sixty-five, (65.00) feet wide to be
located on the following described real property:
A tract of land located in the southwest one-quarter of Section 2,
Township 2 South, Range 5 East, P,M.M" Gallatin County, Montana,
The easement is more particularly described on the attached
Exhibit(s) "A" and "E" which by this reference are made a part hereof.
The GRANTOR states that they possess the real property described above and that they have
a lawful right to grant an easement thereon,
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
Thc terms, covenants, and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto,

A tract of land located in the southwest one-quarter of section 2, Township 2 South, Range 5
East, P,M,M., Gallatin County, Montana, described as follows:
The centerline of a 65,00 foot wide public street (Oak Street) easement more particularly
described as follows:
Commencing at the center one-quarter of said Section 2, Thence South 00041' 38" East along
the north-south mid-section line, a distance of 32,50 feet to the True Point of Beginning;
Thence South 89022'29" West, a distance of 2310.48 feet to the west property line of Gateway
Limited Partners and the end of this easement;
The side lines of said easement being lengthened or shortened so as to begin on the north-
south mid-section line of Section 2 and end upon the west property line of the Gateway
Limited Partners parce1.
Said Tract contains 3.448 acres, more or less,
