PUBLIC STREET AND UTILITIES EASEMENT
Dennis Balian and Joni Balian, of Bozeman, Montana, GRANTORS, in considcration of$1.00 and
other valuable consideration, receipt of which is hereby acknowledged, grant to the City of Bozeman,
a municipal corporation of the State of Montana, with offices at 411 East Main Street, P.O. Box 640,
Bozeman, Montana 95771-0640, GRANTEE, two (2) perpetual public street and utility easements
for the use ofthe public, in, over, under, and across, two (2) strips ofland of varying width, situated
in Gallatin County, Montana, being that part of a parcel ofland on file and of record with the Gallatin
County Clerk and Recorder's Office on Film 151 and Page 463, located in the Southeast Quarter of
the Northwest Quarter of Section II, Township 2 South, Range 5 East, of P.M.M., and more
particularly described as follows:

The GRANTORS warrant that they are lawfully seized and possessed of the real property described
above, that they have and that they will forever defend the title to this property against the claims of
all persons.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTORS.
The tenns, covenants, and provisions ofthis easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors, and assigns of the parties hereto.
