HomeMy WebLinkAbout06- Montana Rail Link, Inc.; Railroad Concrete Crossing Agreement RAILROAD CONCRETE CROSSING AGREEMENT Railroad MP 140.53 DOT ID - 060 055 B Bozeman, MT L Street AGREEMENT, made this ~ sj: day of ,~~02006, between the City of Bozeman, a political subdivision of the State of Montana, hereinafter called the "CITY", and Montana Rail Link, Inc., a Montana Corporation, hereinafter called the "RAILR 0 AD". WITNESSTH: WHEREAS, the CITY is proposing a street project which includes installation of a two 32 foot long concrete crossings across the RAILROAD's right-of-way in Bozeman, MT on L Street, and WHEREAS, it will be necessary for the RAILROAD to perform certain work on its facilities for this project, and WHEREAS, the CITY will fund purchase of the concrete crossing surfaces and the RAILROAD will fund reconstruction of its track structure within the limits of L Street and installation of the concrete crossing surfaces, NOW, THERFORE, in consideration of the promises herein contained, the parties agree: The RAILROAD will coordinate installation of the crossing surface with the CITY's maintenance forces. The CITY will provide roadway traffic control which will include a closure of the railroad crossing to all vehicular traffic for a period of not more than three (3) working days. The CITY will remove and dispose of all old roadway asphalt and place any new asphalt required to complete the project. II The CITY will reimburse the RAILROAD for the actual cost of purchasing and transporting the concrete crossing surfaces to the work site. The estimated cost of the concrete crossing materials to be billed to the CITY is shown on the estimate attached hereto marked as Exhibit "A" and made a part of this agreell1ent. The RAILROAD will submit a final and complete hilling of incurred eosts no later than two (2) months after installation of the concrete surfaces. Records are to be available to the CITY or their authorized representatives for audit during the contract period and for a period of one ( I) year from the date of final payment. III The RAILROAD will, at their expense, furnish alllahor to install the concrete surfaces and furnish all labor and materials for the required work on its track. IV The RAILROAD will maintain the concrete crossing surfaces in accordance with the laws and rules of the State of Montana. This Agreement will inure to the benefit of and be binding on the parties hereto, their successors and assigns. MONTANA RAIL LINK, INC.
