AMENDMENT TO WEST BEALL STREET PAVING IMPROVEMENTS

THIS AMENDMENT, made this 6th day of Jul y , 1999, between the City of
Bozeman, hereinafter called "OWNER" and Big Sky Asphalt, hereinafter called
"CONTRACTOR" .
WHEREAS, the Parties have entered into an agreement for the Contractor to complete
the work for the West Beall Street Paving Improvements, dated June 11, 1999
WHEREAS, paragraph 5.4 of the Supplementary Conditions to the General Conditions
provides that there be automobile liability insurance in the amount of$1,500,000.00, which
cannot be satisfied by excess or umbrella insurance;
WHEREAS, it is difficult to find insurance in $500,000.00 increments, above
$1,000,000.00 for an automobile liability policy;
WHEREAS, the Montana Public Works has used an addendum to the Fourth edition -
which lowers auto liability insurance to $1,000,000.00; and
WHEREAS, USF&G's $1,000,000.00 umbrella policy will cover excess auto liability for
the underlying $1,000,000.00 policy issued by USF&G Company.
THEREFORE, in consideration of the foregoing recitals and the consideration in the
original agreement, the Parties agree to amend the agreement as follows:
1. Paragraph SC-5.4(G) shall be amended to read as follows:
(G) CONTRACTOR'S Liability Insurance under 5.4.3,5.4.4,5.4.5 and 5.4.6
may be satisfied by primary insurance or a combination of primary and
excess or umbrella insurance. Primary occurrence limit cannot be less
than $1,000,000.00 Deductible not to exceed $5,000.00 per occurrence on
property damage.
2. Except as specifically amended herein, the original agreement shall remain in full
force and effect and the Parties shall be bound by all terms and conditions therein.
