PARTIAL RELEASE OF EASEME~IGHT-OF- ~GREEMENT
FOR WATER PIPELINE
KNOW ALL BY THESE PRESENCE, that the City of Bozeman, a
municipal corporation and political subdivision of the State of
Montana, by Alfred M. Stiff, its Mayor, for in consideration of
the sum of $1.00, an amended easement and right-of-way agreement
for water pipeline and for other good and valuable consideration,
the receipt of which is hereby acknowledged by the City of
Bozeman, does hereby release and quitclaim to the successors in
interest of Walter Kraft and Merretta Kraft of the City of
Bozeman, County of Gallatin, State of Montana, and to their heirs,
devisees, personal representatives, assigns or successors,
insofar as the following described easement applies to Lot Three
(3) of Block Four (4 ) Hodgeman Canyon Subdivision located in
Section 11, Township 3 South, Range 5 East, Prinicpal Meridian
Montana, all the right, title, interest, claim or use whatsoever
the City may have acquired in, through or by an Easement and
Right-of-Way Agreement for Waterpipe Line (sic) dated August 6,
1957 entered into by and between the City of Bozeman and Walter
Kraft and Merretta Kraft, husband and wife, of Bozeman, r.1ontana
for a water pipeline under the premises hereinafter described
which agreement was recorded in the Recorder's Office of Gallatin
County, Montana, on August 15, 1957 in Book 17 of Miscellaneous
at pages 435 through 438 as Document Number 16617 which agreement
created a 30-foot easement for a water pipeline under the premises
located in the southeast quarter of Section 11, Township 3 South,
Range 5 East, M.P.M. which is more particularly described as
follows:

"A perpetual easement and right-of-way for the purpose
of installing, operating, using, repairing, replacing,
maintaining and removing a water pipeline and
appurtenances thereto upon and across the above-described
property of the Grantors, said easement and right-of-way
to consist of a strip of land thirty (30) feet in width
lying and being fifteen (15) feet on each side of the
following described centerline:
Beginning at a point, which point is east along the
south line of Section 11, Township 3 South, Range 5
East, M.P.M., a distance of 133.5 feet from the South
one-quarter corner of said Section II-thence North
21008' East, a distance of 1,662 feet; thence North
65034' East, a distance of 1,973 feet more or less to
the East property line of said parcel of land. A total
distance of 3,635 feet, or 220.30 rods or 0.69 miles."
In witness whereof, the City of Bozeman, has executed this
instrument by its Mayor on the :n'f!.- day of 4;vkt--- , 1988.
