AGREEMENT and GRANT OF POSSESSION

.THIS AGREEMENt AND GRANT OF POSSESSION made and entered into this 7 day of
,1970 by and between the STATE OF MONTANA, acting by and through its
Highway Commission and Martha Bolles Palffy, landowner , of Gallatin County,
Montana.
This Permit and Grant of Possession to the State of Montana and its assignl
covers that. portion of t,e owners land for construction and installation of a 24"
sanitary sewer line and a~ 8" water line, over and across the owners land, and
~ designated as Lots n - 12 ... 13 ... 14 6. 15 of the Story Additio n to the City of
~zeman, Montana.
Said construction is being performed by a Contractor under contract by the City
of Bozeman, Montana, and this permission is for the said Contractor to enter upon
the owners land for the cOnstruction of the above facilities.
This Permit is given with the understanding that the State is in the process of
appraising the right of way that will be required for construction of Project U.S.449(1),
which said project is for the connection of 11th Street to Main Street in Bozeman,
Montana, with said right-of-way being that certain tract of land in Lots 11-12-13-14-
0, & 16 of the Story Addition, and are colored in red in Exhibit "A" attached hereto,
and the land covered by this Permit is identified.in green lines thereon.
It is further understood that the State will be making an offer for the purchase

of necessary right of way'within a period of ninety (90) days from the date of thi_
Permit and Grant of Possession.
It is further understood that this said Permit and Grant of Possession covers
only that portion of the owner's land which is required for the 24" sanitary sewer.

way that will be for the construction of the Highway Project for connection of 11th
Street to Main Street.
