installing, operating, using, repairing, replacing, maintaining and
removing a sanitary sewer thereto upon and across the abuve described

2. The perpetual right nf ingr~ss anrt egress tn and from
said tract of land at all reasonable times for tIle purpose of installing,
operating, using, repairing, replacing and maintaining said sanitary
sewer pipeline and for the removing 0f same if and
when desired by the Grantee, its successors and assigns:
TO HAVE AND TO HOLD the above described right "f ~';1y with
all the appurtenances and privileges unto th~ said GrAntc~
and to its successors nnd assigns forever.
The Grantee hereby covenants and agrees with the Grantor
as follows:
1. That, in connection with the installing, operating,
using, repairing, replacing, l1Ulintainlng and removing,
of said sanitary sewer pipeline it will replace at its
sole expense, all existing fences, ditches and other appur-
tenances of said land that may be disturbed by its operation
in a condition equal to the condition thereof existing before
said operations were begull, or as near thereto 8S shall be
reasonably possible.
2. That, during operations involving excavation, it will
remove the topsoil from the trench area to a depth of one
foot, or to the full depth of the topsoil whichever is less,
and stockpile said topsoil for replacement over the trench,
and will remove from the si.te any large rocks or surplus
excavated material or any kind of debris that ~~y have been
exposed by the excavat_i.on and remaining after hackfilling
is completed and will leave the finished surface in substan-
tially the same condition that existed prior to the beginning
of operations except tbat the surface of backfilled areas may
be mounded sufficiently to prevent the formfltion of depressions
nfter final settlement has taken place.
3. To operate, use and maintain said sanitar'y sewe~ipeline
__~_____~ in Ruch manner as will not hinder or prevent the
proper cultivation of the tract through which this right of
way is hereby granted.
4. In the event that it shoLid become necessary for the
Grantee to re-enter the Grantors premises for the purpose
of repairing, replacing, maintaining or removing said utility
lines the Grantee will reimburse the Grantors for any actual
damage done to the Grantors premises or crops.

operating, repairing, maintaining a sanitary sewer pipeline

Range 6 East, Principal Meridian Montand, Galliltin County,
Montana, described in book 139, page 262, filed in the
Gallatin County Clerk and Recorder's Office.
The easement
is more particularly described us a 30 foot wide perpetual
easement, 15 feet on each side of the trunk sewer line as
constructed and descrihed below:
Beginning in the North 1/4 corner of Section 17, Township 2
South, Range 6 East; thence South 890 59' East along the
north boundary line of said Section 17, a distance of 168
feet, more or less, to the centerline of said trunk sewer
line; thence South 40 West along said centerline, a distance of
275 feet, more or less; thence South 170 3D' West along said
centcrline,.u distance of 186 feet, more or leSe;; thence South
440 West, along said centerline, a distnnce of 178 feet, more
or less; thence South 40 Fast along said centerline, a distance
of 315 feet, more or less; thence South 170 East along said
centerline, a distance of 50 feet, more or less, to the south
boundary line of said tract of land descl-ibed in book 139,
page 262, and containing 0.7 acres.

Dear Martin & Eva:
This letter is to assure and confirm that as a condition to your
granting the City of Bozeman an easement across your property for a
sewer line, the City will connect your existing residence to said
sewer line at no cost to you.
The City w"ill also reimburse you the sum of SIGel for the inter-
ruption of use of approximately one acre of your pasture for about
two years which should be sufficient time for the pasture to regener-
ate growth to it~ normal level. .
