SUBJECT: Expansion of the Montana State University (MSU) Residential Parking
Permit District (RPPD) to include two additional blocks; 900 block of South Grand Avenue and Alderson Street from South 14th to South 15th.

RECOMMENDATION: Final Adoption of Ordinance No. 2010, expanding the boundaries of
the MSU Residential Parking Permit District to include the 900 block of S. Grand Avenue and Alderson Street from S. 14th to S. 15th.
BACKGROUND: On September 17, 2018 the City Commission provisionally adopted
Ordinance 2010 expanding the MSU Residential Parking Permit District. Tonight’s action would
finally adopt the resolution which would go into effect in 30 days.
The City of Bozeman has two residential parking districts; Montana State University and Bozeman Senior High School. The districts were created to regulate non-resident parking in neighborhoods impacted by the unique presence of MSU and the High School. The boundaries of these residential parking districts are defined in Municipal Code and have been modified occasionally as growth or circumstances have dictated. Presently the City has requests from residents near the MSU district to expand to include the 900 block of South Grand and Alderson Street from South 14th to South 15th. We have studied both requests and recommend including them in the district. Both street blocks are directly contiguous to the MSU RPPD, and their adjacency to the existing district map fills in existing RPPD blocks without enlarging the outer boundaries of the district. Attached to this memorandum is a map of the existing district with the proposed expansions indicated. FISCAL EFFECTS: There will be minimal costs to add signage.

ORDINANCE NO. 2010
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA AMENDING SECTION 36.04.360 OF THE BOZEMAN MUNICIPAL CODE
TO INCLUDE THE 900 BLOCK OF SOUTH GRAND AVENUE AND THE SEGMENT
OF ALDERSON STREET BETWEEN SOUTH 14TH AVENUE TO SOUTH 15TH AVENUE
IN THE MONTANA STATE UNIVERSITY RESIDENTIAL PARKING PERMIT
DISTRICT.
WHEREAS, Sect. 61-12-101(1), MCA, authorizes the City of Bozeman to regulate the
standing and parking of vehicles; and
WHEREAS, the City Commission of the City of Bozeman finds that concerns regarding
the public health, safety, and general welfare of the citizens and residents of Bozeman requires the
establishment of ordinances for the orderly parking of motor vehicles upon the public ways of the
City of Bozeman; and
WHEREAS, the City Commission adopted Ordinance No. 1377 in 1994, creating a
residential on-street parking permit regulation program in the vicinity of Montana State University
(MSU Residential District) and providing a procedure for revising the boundaries of this program.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOZEMAN, MONTANA:
Section 1
That Section 36.04.360 (A) of the Bozeman Municipal Code be amended to read as follows:

A. The area designated, pursuant to this article, as the Montana State University Residential
On-Street Parking Permit Program, and hereinafter referred to as “MSU Residential
District,” shall be as follows, and as depicted on Exhibit “A” attached hereto, (listed streets
and avenues include the full right-of-way unless specifically noted):

Beginning at the northwest corner of the intersection of South 12th Avenue and West
Dickerson Street, thence southerly along the west right-of-way of South 12th Avenue to
the north right-of-way of West Alderson Street, thence westerly along the north right-of-
way of West Alderson Street to the west right-of-way of South 13th Avenue, thence southerly along the west right-of-way of South 13th Avenue to the centerline of West

West Dickerson Street to the Point of Beginning.
The district shall also include South 14th Avenue from West Dickerson Street to West
College Street, the western half of South 15th Avenue from West Dickerson Street to West Alderson Street, South 15th from West Alderson Street to West College Street, West Alderson Street from South 13th Avenue to South 15th Avenue, and 900 block of South
Grand Avenue.
Section 2
Repealer.
All provisions of the ordinances of the City of Bozeman in conflict with the provisions of this
ordinance are, and the same are hereby, repealed and all other provisions of the ordinances of the
City of Bozeman not in conflict with the provisions of this ordinance shall remain in full force and
effect.
Section 3
Savings Provision.
This ordinance does not affect the rights and duties that matured, penalties that were incurred or
proceedings that were begun before the effective date of this ordinance. All other provision of the
Bozeman Municipal Code not amended by this Ordinance shall remain in full force and effect.

Section 4
Severability.
That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of
this ordinance as a whole, or any part or provision thereof, other than the part so decided to be
invalid, illegal or unconstitutional, and shall not affect the validity of the Bozeman Municipal Code
as a whole.
Section 5
Codification.
The provisions of Section 1 shall be codified as appropriate in Chapter 36, Article 4 of the
Bozeman Municipal Code.
Section 6
Effective Date.
This ordinance shall be in full force and effect thirty (30) days after final adoption.

PROVISIONALLY ADOPTED by the City Commission of the City of Bozeman,
Montana, on first reading at a regular session held on the 17th day of September, 2018.

FINALLY PASSED, ADOPTED, AND APPROVED by the City Commission of the
