THIS AGREEMENT, Made and entered into this
16th
day of
November A. D. 19 R, by and between _ Ma rte 1 Properti es,
. with offices located at 1203 S. Church Avenue,
a partnershlp iJartL of the first part, hereinafter
called the Grantor and THE CITY OF BOZEMAN, a municipal corpor-
ation of the State-of Montana, in Gallatin County, the party of
the second part, hereinafter called the Grantee.

WHEREAS, The Grantor

a tract of land in east Bozeman
WHEREAS, The Grantee, in the exercise of its power and authority
as a municipality of the State of Montana, proposes to construct and
install a water main and necessary appurtenances to serve
various propertl-es-located within the eastern portion to the
City of Bozeman and one or more such lines would ru~'~cross the
Grantors land; and
WHEREAS, The Grantee des i res to acqui re from the Grantor
and the Grantor is wi 11 i ng to grant to the Grantee an ease-
ment and right aT-waY-across the above described property of the
Grantor ,and its heirs, executors, administrator's, successors,
and assigns, for the purpose of installing, operating, using, repair-
ing, replacing, maintaining, and removing said water main
and appurtenances and for such other rights of acce-s's-'-a-rldincidental
rights as are hereinafter described, all as hereinafter more particul-
arly provi ded.
NOW, THEREFORE, in consideration of the sum of $ 1,000* and
other considerations in hand paid by the City of Bozerila-n-~'-'fhe receipt
whereof is hereby acknowledged, and in further consideration of the
covenants and agreements between the parties hereto, the Grantor
has granted, bargained, sold, conveyed;'--
and confirmed and by these presents does hereby grant, bargain,
se 11, convey, and confi nn unto the saldGrantee and its successors
and assigns the following rights and privileges forever:
1. A perpetual easement and right of way for the purpose of
installing, operating, using, repairing, replacing, maintaining
and rernov i ng a water ma in thereto upon and ac ross the above
described property of the Grantor , said easement and right of
way to consist of a strip of land fi~ to 10' O!L....tb..e.....,s.o..ut.~--Pr..o..perty line, 30' on the
feet in width being more particularly described as follows: west property line.
An easement located in the Northeast quarter, Section 18, Township 2
South, Range 6 East, Principal Meridian Montana, City of Bozeman, Gallatin
County, Montana. Said easement is located on a tract filed on Film 5,
pages 455 and 456 of the Gallatin County Clerk and Recorder's records,
and is more particularly described as follows:
Beginning at the northwest corner of said tract; thence South 00000'57"
East, along the westerly boundary of said tract, a disbance of 224.12 feet
to the southwest corner of said tract; thence North 89 11'50" East, along
the southerly boundary of said tract. a distance of 792.00 feet to the south-
east corner of said tract; thence North along t~e easterly boundary of said
tract, a distance of 6.00 feet; thence South 89 11'50" West. parallel to the
southerly boundary of said tract, a dista8ce of 145.00 feet; thence North,
a distance of 14.00 feet; thence South 89 11'50" West, parallel to the
sogtherly boundary of said tract, a distance of 617.10 feet; thence North
00 00'57" West, and parallel to the westerly boundary of said tract, a distance
of 203.70 feet to a point on the northerly boundary of said tract; thence West.
a distance of 30.00 feet along the northerly boundary of said tract to the
point of beginning. In addition, a 10' construction easement is granted
on the north side of the permanent easement.

2. The perpetual right of ingress and egre~8 to and from
said tract of land at all reasonable times for the purpose of installing.
operating. using. repairing, replacing and maintaining said
water main and for the removing (If same if and
when desired by the Grantee, its successors and assigns:
TO HAVE AND TO HOLD the above described right of way with
all the appurtenances and privileges unto the said Grantee
and to its successors and assigns forever.
The Grantee hereby covenants and agrees with the Grantor

1. That, in connection with the installing. operating.
using, repairing, replacing, maintaining and removing.
of said water main it will replace at its
sole expense, all existing fences, ditches and other appur.
tenances of said land that may be disturbed by its operation
in a condition equal to the condition thereof existing before
said operations were begun, or as near thereto as shall be
reasonably possible.
2. That, during operations involving excavation, it will
remove the topsoil from the trench area to a depth of one
foot, or to the full depth of the topsoil whichever is less,
and stockpile said topsoil for replacement over the trench,
and will remove from the site any large rocks or surplus
excavated material or any kind of debris that may have been
exposed by the excavation and remaining after backfilling
i. completed and will leave the finished surface in substan.
tially the same condition that existed prior to the beginning
of operations except that the surface of backfilled area. may
be mounded sufficiently to prevent the formation of depres8ion.
after final settlement has taken place.
J. To operate, use and maintain said water main
in Ruch manner a8 will not hinder or prevent the
proper cultivation of the tract through which this right of
way is hereby granted.
4. In the event that it shodd become necessary for the
Grantee to re-enter the Grantors premises for the purpose
of repairing, replacing, maintaining or removing said utility
lines the Grantee will reimburse the Grantors for any actual
damage done to the Grantors premises or crops.

*Conditions:
1. The City will pay the Owner $1.000 to move the construction materials
now sitting on the easement aside during construction and put them
back after construction is completed.
2. A Type II excavation requiring shoring will be used throughout
this easement to prevent the very unstable materials from sluffing.
Excavation performed as Type II shall be adequately shored and
sheeted in accordance with the minimum requirements of OSHA
Regulations. and as indicated on Standard Drawing 11-01 (attached).
Portable trench boxes or sliding trench shields may be used for
performing Type II excavation in lieu of a shoring system, provided
they are designed, constructed and maintained in a manner which
will provide protection equal to or greater than the sheathing or
shoring required for the trench.
3. A Type II backfill will be used. which 'is largely granular
rnaterial, so as to stabilize the area so as to allow it to be
used for storage as soon as construction is cornplete and the
line is accepted,
