Res. 4953, Amend. 2 to Construction Agreement with R&R Taylor for Story Mill Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Trails, Open Space, and Park Development Manager Mitch Overton – Director of Parks and Recreation SUBJECT: Resolution 4953 – Amendment No. 2 to Construction Agreement with R&R Taylor, Inc. for Story Mill Community Center Renovation Project MEETING DATE: September 10, 2018 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution 4953 for Change Order No. 2 to the Construction Agreement with R & R Taylor Construction, Inc. for the Story Mill Community Center for the additional amount of $15,410 for a new contract total not to exceed $225,310 and authorize the interim city manager to sign the Amendment (Attachment A). BACKGROUND: Renovation work to include office space remodeling and building code upgrades for the new Story Mill Community Center was bid out in December 2017. Commission approved a Notice of Award to the lowest responsible bidder, R&R Taylor, Inc. with a base bid amount of $250,000. During the course of building permit review, additional fire code-related needs were identified. Amendment No. 1 removed mechanical ventilation improvements at a cost savings of $40,100 for a revised contract total of $209,900. Three additional field orders have been submitted by the architect for approval. The Contractor’s adjusted scope of work includes addition of the following, for a new contract total of $225,310: 1. Fire suppression and access (code requirements) 2. ADA sidewalk connection 3. Additional door closers 4. Lockable roll-up counter door A summary of the project budget is as follows: FY ’17 – ’18 CIP funding: $285,000 Architect’s contract: -$ 61,550 Construction contract: -$250,000 Amendment No. 1 +$ 40,100 Amendment No. 2 -$ 15,410 -$ 1,860 (overage covered by Facilities for ADA upgrades) 219 UNRESOLVED ISSUES: None. ALTERNATIVES: Per Commission. FISCAL EFFECTS: Amendment No. 2 will allow the project to be completed in compliance with fire code and ADA regulations. FOR THE STORY MILL COMMUNITY CENTER RENOVATION PROJECT WHEREAS, on January 8, 2018the City Commission approved the Notice of Award for Story Mill Community Center Renovation Project (“Project”); and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any alterations or modifications of the specifications and/or plans of a contract be made by resolution; and WHEREAS, work has been identified to be removed from the scope of the original contract in order to provide contingency for unforeseen needs including building and fire code upgrades; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modification to the contract between the City of Bozeman, a municipal corporation, and R & R Taylor Construction, Inc. as per Amendment No. 2, (“Attachment A”) attached hereto, is hereby approved; and the City Manager is hereby authorized and directed to execute the contract amendment for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 221 PASSED, ADOPTED, AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 10th day of September, 2018. ___________________________________ CYNTHIA ANDRUS Mayor ATTEST: _____________________________________ ROBIN CROUGH City Clerk APPROVED AS TO FORM: ___________________________________ GREG SULLIVAN City Attorney 222 ATTACHMENT A Amendment No. 2 to Construction Contract with R & R Taylor Construction, Inc. for Story Mill Community Center Renovation Project THIS AGREEMENT is made as of this ____ day of __________________, 2018, between the CITY OF BOZEMAN, a Municipal Corporation, whose address is P.O. Box 1230 Bozeman, Montana, 59771-1230 (CITY) and R&R Taylor, Inc. whose address is 1775 Love Ln, Bozeman, MT 59718 (CONTRACTOR). WHEREAS, the parties have entered into an Agreement dated January 19, 2018 for construction services for the Story Mill Community Center Renovation Project; and WHEREAS, revisions to the scope of services are necessary to complete the Project in order to provide contingency for unforeseen code upgrades and other needs; and WHEREAS, the parties desire to amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in Amendment No. 2 to Scope of Work for Story Mill Community Center Renovation Project (“Exhibit A”) are hereby incorporated in and made part of this agreement. Article 3 – Contract Price: Article 5 of the original agreement is modified as follows: • Amendment No. 1 - $40,100 • Amendment No. 2 +$15,410 • New contract total $225,310 Except as specifically amended herein, the original agreement shall remain in full force and effect and the Parties shall be bound by all terms and conditions therein. 223 IN WITNESS WHEREOF, the parties hereto do make and execute this Agreement.
