Report Date: August 10, 2018 BACKGROUND: The City Commission receives the Van Winkle Stadium Improvements Master and Phase 1 Site plan application and conducts a public hearing on the agency exemptions the Bozeman School District 7 is claiming under M.C.A. Section 76-2-402.” (Other than conducting a public hearing on the exemptions, no official motion is required by the City Commission). The new Bozeman School District multi-purpose stadium project is a Master Plan project of a 3,200-seat stadium north of the existing Van Winkle Stadium located at 205 N 11th Avenue, Bozeman, MT 59715. The District is claiming agency exemptions from compliance with certain zoning standards under Montana Code Annotated (M.C.A.) Section 76-2-402. The development proposed will not meet several municipal zoning standards required in the Unified Development Code, Article 38 of the Bozeman Municipal Code. The areas included in the project are the relocated two softball fields and dugouts, relocated batting cage, a new 5,576 sq. ft. team building and 2,624 sq. ft. fan (support) facilities including bathrooms and concessions, turf field, corresponding pathways, fencing, Ruth Thibeault Way parent drop off traffic development with roundabout, an expanded east parking lot, lighted pedestrian path to the south parking lot, demolition of existing south Van Winkle Stadium bleachers, and demolition of the existing stadium lights. Phase I of the project includes the 3,200 person stadium, the relocated two softball fields and dugouts, relocated batting cage, a new 5,576 sq. ft. team building, a 2,624 fan (support) facilities including bathrooms and concessions, turf field, corresponding pathways, fencing, an upgraded connection from the existing northeast parking lot to the newly updated central parking lot, an expansion and modification to the central parking lot and modifications to the parking connection to the existing Ruth Thibeault way. There is also a new pedestrian crossing connecting the stadium to the west sidewalk at 15th street midblock. Two streamline bus shelters will also be provided at existing Streamline stops. Phase II of the project includes a roundabout at N 15th Ave. and W Beall St., an improved Ruth Thibeault turn around and drop off with two one way drives and modifications to the east parking lot for integration into the improved said drop off. This phase also includes a lighted pedestrian pathway connecting the stadium to the south parking lot. Demolition of the existing Van Winkle south stadium bleacher and the existing stadium lights will also be part of the Phase II. 249 Commission Memo Second Bozeman High School Application: 18085 and 18265 August 20, 2018 Page 2 of 3 Montana law (M.C.A. Section 76-2-402) addresses the relationship of municipal zoning regulations to a school district’s use of land. The law requires a public hearing whenever land is to be used contrary to zoning regulations. The statute expressly provides that a municipality “shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use.” The requirement for a public hearing before the City Commission on such exemptions was specifically included in the 2012 Interlocal Agreement executed between the School District and the City. In this regard, the School District is claiming exemptions to the Bozeman Municipal Code provisions, with provided rationale as follows: 1. Sec. 38.550.050 / B. Additional Screening Requirements - This requirement creates screening that we (the Bozeman School District 7) feel like would decrease visibility on the property. The intent is to provide a higher level of safety for students. In addition, because the location of the new parking lot is in the middle of campus, there will be very limited visibility of the parking lot. 2. Sec. 38.550.050 / C. Parking Lot Landscaping Requires that parking lots with more than 15 spaces shall have a minimum of 20 sf of landscape area within the parking lot for each off-street parking space in a lot. It remains the Bozeman School District’s policy to provide uninterrupted paved areas within all school parking lots. The intent is to provide better visual access and a higher level of safety for the students within the parking lots. In addition, because the location of the new parking lot is in the middle of campus, there will be very limited visibility of the lot from the surrounding city streets. 3. Sec. 38.520.050/ D. Vehicular Circulation and Parking Requires that street trees and sidewalks are provided per standard roadway design for internal roadways as well as city streets. Due to existing site features such as site fences and drainage conveyance, street trees and sidewalks cannot easily be installed to city standards. Pedestrian circulation and landscaping are still implemented in the design including existing trees and new trees planted along the roadway to the south and north of Ruth Thibeault Way, but will not specifically adhere to city design standards. 4. Sec. 38.510.030/ C and 38.510.030/ G Block Frontage Designations - The block frontages for this site are “other” and “mixed”. The mixed block frontage requires no more than 50% of site frontage shall be parking of which is in conflict with the 100% of the existing street frontage as an existing 15th street parking lot that will be used for the parking count calculations and traffic/ safety vehicle functions out of the stadium onto 15th street. These block frontages also require building placement to be at the sidewalk edge which is also in conflict with the placement of the existing parking lot. The stadium buildings, at 245’ away from the street will also not comply with the requirement for façade transparency and instead will be screened properly per plank wall treatment requirements. 5. Sec. 38.540.060.B.1 Joint Use of Parking Facilities - This section requires that parking facilities provided by another building or use must be located within 1,000 feet of the entrance to the building or use which the application being made. Parking for all uses and facilities within the Existing Bozeman High School campus is provided on-site or on-street adjacent to school property, however, due to the size of the campus, some of these parking facilities are great than 1,000 feet away from entrances to buildings on campus. This exemption is applied only to walking distance between facilities and parking areas, total spaces required for all uses within the joint use analysis are provided on or immediately adjacent to school property and no required parking for any one facility or use is further than 1,600 feet from an entrance. 6. Sec. 38.540.070.A.5 Off-site Parking The off-site parking for the school and stadium will not be complying with the following mandatory parking provisions: Per Sec. 38.540.060.A.5 Off-site Parking – requires that parking facilities provided by another building or use must be located within 1,000 feet of 250 Commission Memo Second Bozeman High School Application: 18085 and 18265 August 20, 2018 Page 3 of 3 the entrance to the building or use which the application is being made. Parking for all uses and facilities within the Existing Bozeman High School campus is provided on-site or on-street adjacent to the school property, however, due to the size of the campus, some of these parking facilities are greater than 1,000 feet away from entrances to the buildings on campus. This exemption is applied only to walking distance between facilities and parking areas, total spaces required for all uses are provided on or immediately adjacent to school property and no required parking for any one facility or use is further than 1,600 feet from an entrance. 7. Sec. 38.520.040.C.4 Non-Motorized Circulation The parking for the school and stadium will be requesting an exemption from the following mandatory provisions: Per Sec. 38.520.040.C.4 Non- Motorized Circulation and Design, Internal Circulation - requires that parking lots provide pedestrian paths through lots every four rows or a maximum of 200’. Following the public hearing, Staff will complete the site plan application review process including the claimed exemptions and prepare a staff report for consideration by the Director of Community Development. Joint Use of Parking Facilities - Please review the required conditions for joint use. Off-street parking must be located within 1,000 feet as such parking facilities as measured by the route of travel from the nearest parking space to the commonly used entrance of the principal use served. All pathways must be along a safe and defined pedestrian pathway.This previous comment has not be addressed, parking distances exceed 1000 feet. (Sec. 38.540.060) Response: An exemption is requested for the pedestrian path of travel distance to parking facilities. Parking analysis has been modified to reflect this. c. Off-Site Parking. Off-site parking for nonresidential uses may not be located more than 1,000 feet from the entrance of the principal use. Please modify parking analysis. (Sec. 38.540.070.A.5.) Response: An exemption is requested for the off-site parking for the school. ENGINEERING DIVISION The application is inadequate for further review. The applicant must provide a traffic impact study that meets the requirements of Bozeman Municipal Code (BMC) 38.220.080.A.2.i, which subsequently references BMC 38.220.060.A.12. Additional review will be provided upon submittal of the traffic impact study. Response: Traffic impact study is ccurently being updated and will be submitted to engineering immediately upon completion 1. The applicant must construct the proposed mid-block crossing of N. 15th Avenue at the terminus of the sidewalk on the east side of N. 15th Avenue instead of at the proposed location (BMC 38.400.110). The applicant must demonstrate this item on the master site plan drawings prior to master site plan approval. Response: The current crosswalk location was recommended by our transportation engineer (Bob Marvin). If it is located at the terminus of the existing sidewalk on the east side of 15th it will be in conflict with a residential driveway on the west side. The proposed location of the crosswalk as currently shown is located as far as possible from residential driveways to provide as much sight distance as possible to avoid pedestrian/vehicle conflicts. NW ENERGY 1. Please contact Northwestern Energy for project review, which is separate from the City Review process. Response: See previous comment that describes we are in current coordination with Northwestern Energy. “The Northwestern Energy’s engineer Derek Westveer has been contacted and coordinated with. Northwestern Energy has received a new service application. Major Utility locations and routing has been coordinated with NWE for the Bid Set drawings.” 2. Any transformer locations must maintain 10 feet separation from any combustible building surface or 2 feet from a non-combustible building surface (non-combustible surface include brick, cinder block, concrete, and stone. Stucco is considered combustible). Due to tight configuration of some buildings please insure this separation can be met. Response: See previous comment: “The Utility transformer location is shown on Sheet ES1-02. This location is roughly 35ft from the nearest combustible or non-combustible building.” 3. Existing underground power line to the west of the new stadium needs to be relocated to provide adequate separation from water lines to the north. Propose relocating along North 15th Street. Response: See previous comment: “The relocation of the existing single phase power line has been coordinated directly with Northwestern Energy. The re-route will be provided by NWE and will run between the existing parking lot and 15th Ave. as requested.” 5. Need Utility Easements shown for all existing and proposed utilities. Response: Existing utility easements are shown on C4.0 EXEMPTIONS: The above mentioned High School multi-use stadium per part I.1.d of the Interlocal Agreement School District 7 – City of Bozeman dated November 12, 2012 permits an exemption from site development standards inducing, but not limited to, landscaping, lighting, and parking. We have taken efforts to comply with standards where possible; however, it has been determined that certain conditions resulting from the standards would reduce the safety and security of the students using the facility.
