BACKGROUND: Resolution No. 4521 was unanimously approved by the Commission April 14, 2014 for the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to
exceed $7,500,000 for the acquisition of park land and development of the Bozeman Sports Park
Project (“Park Project”), which requires professional design and engineering services. The
resolution allocated up to (i) $2,100,000 for the acquisition of approximately 80 acres of park land;
(ii) up to $1,788,000 for infrastructure improvements as stated in the Commission motion adopted April 7, 2014; and (iii) the remainder of the $7,500,000 for park development and construction of
the approved Bozeman Sports Park Master Plan. Resolution 4844 allocating an additional
$917,000 in TOP bond funding was approved by Commission for construction of the project.
TD&H Engineering completed the initial soils report in 2014, which included analyses and
recommendations for natural turf fields and paving. Contracts with FieldTurf® to provide and install synthetic turf fields were executed on June 11, 2018. Preliminary design and engineering for
the fields and associated infrastructure (grading, drainage, and irrigation) was completed in mid-
July and initial grading began in late July. FieldTurf® has now requested that a geotechnical report
and recommendations specific to the synthetic turf installation be provided prior to further grading
operations in order to ensure appropriate preparation of the subgrade and warranty of their product.
The FieldTurf® proposal incorporated into the contracts excludes such work:

must agree in writing upon any additional charges.
5. Contractor’s Representations: To induce City to enter into this Agreement,

compensation granted by law for independent contractors.
In the event that, during the term of this Agreement, any labor problems or disputes of any
type arise or materialize which in turn cause any services to cease for any period of time, Contractor
specifically agrees to take immediate steps, at its own expense and without expectation of
reimbursement from City, to alleviate or resolve all such labor problems or disputes. The specific
steps Contractor shall take shall be left to the discretion of Contractor; provided, however, that
Contractor shall bear all costs of any related legal action. Contractor shall provide immediate relief
to the City so as to permit the services to continue at no additional cost to City.
Contractor shall indemnify, defend, and hold the City harmless from any and all claims,
demands, costs, expenses, damages, and liabilities arising out of, resulting from, or occurring in

of indemnity that would otherwise exist. The indemnification obligations of this Section must not be
construed to negate, abridge, or reduce any common-law or statutory rights of the indemnitee(s)
which would otherwise exist as to such indemnitee(s).
Contractor’s indemnity under this Section shall be without regard to and without any right to
contribution from any insurance maintained by City.
Should any indemnitee described herein be required to bring an action against the Contractor
to assert its right to defense or indemnification under this Agreement or under the Contractor’s

insurance coverage through an insurance company or companies duly licensed and authorized to
conduct insurance business in Montana which insures the liabilities and obligations specifically
assumed by the Contractor in this Section. The insurance coverage shall not contain any exclusion
for liabilities specifically assumed by the Contractor in subsection (a) of this Section.
The insurance shall cover and apply to all claims, demands, suits, damages, losses, and
expenses that may be asserted or claimed against, recovered from, or suffered by the City without

RE: BOZEMAN SPORTS COMPLEX ARTIFICAL TURF
GEOTECHNICAL RECOMENDATIONS
Dear Carolyn,
Thank you for the opportunity to present this proposal to geotechnical engineering services
for the new Bozeman Sports Complex located off Flanders Mill Road and Baxter Lane. It is
our understanding that the City of Bozeman has modified the original design for two of the fields from grass turf to artificial turf. This proposal is for providing recommendations for
the section below the proposed new turf and sub-field drainage. GEOTECHNICAL SCOPE OF WORK
The purpose of our geotechnical investigation is to provide a preliminary analysis of the
onsite soils and their engineering properties with respect to future construction of an
artificial turf field. We propose investigating the site using test pits and anticipate excavating up to four test pits across the site. Test pits will be necessary to gather
adequate subsurface data and samples for use in our material testing and analysis.
The subsurface profile will be observed and logged by an experienced TD&H geotechnical
engineer. Samples will be collected as excavation proceeds if necessary and only if soil
properties differ from the original TD&H Engineering Soils Analysis dated June 2014. If needed, samples will be analyzed in our construction materials testing laboratory to
determine the appropriate physical and engineering properties. If soil properties are the
same as the original report, laboratory testing from that report will be used in our analysis.
We will inform you of any noticeable issues the subsurface conditions may present such as
expansive or settlement potential and the possible need for over excavation of unsuitable soils. The results of our field and laboratory studies and preliminary analyses will be
summarized in a geotechnical engineering report in the form of a letter.
Our field scope of work does not include determining the presence or absence of
subsurface soil and ground water contamination. Test pits will be backfilled and graded to approximate finished ground. Existing topsoil will be spread out as best as possible over
the excavation, but existing vegetation will not be reestablished.
