SUBJECT: Commission Resolution No. 4943 – Amending the City’s Annual Budget
for the Wastewater Impact Fee Fund Appropriations for the Fiscal Year
Ending June 30, 2019 (FY19).

RECOMMENDATION: Approve Resolution No. 4943- Amending the City’s Annual
Budget for Wastewater Impact Fee Fund Appropriations.
BACKGROUND:
This budget amendment concerns an impact fee refund and an impact fee CIP project. First, on
July 23, 2018 the Commission approved Resolution 4939, which provided Wastewater Impact Fee
to Montana State University. The refund amount for water and wastewater impact fees paid for
Yellowstone Residence Hall and Jake Jabs Hall. Both of these facilities paid impact fees at the
time they connected to the water and wastewater systems was approved via the resolution.
Respective fee amounts were determined on gallon per gallon basis. Metered water use for these
buildings show that the MSU is due a refund as their actual water and wastewater demand is much
less than that for which the fees were paid. The refund approved totaled $133,338.26.

Second, Norton East Ranch Interceptor (WWIF 38) was proposed for FY20. The consultant
working on the preliminary analysis of the Norton East Ranch Interceptor has indicated the route
proposed in the sewer master plan may not be feasible either fiscally or from a long-term
maintenance standpoint. Therefore, we need to look at an alternative to the Norton East Ranch
Interceptor, which is to upgrade the existing Baxter Meadows Lift Station and the existing sewer
mains into and out of the Baxter Meadows Lift Station. If the Norton East Ranch Interceptor is
not feasible, this also impacts the sizing of the Davis Lane Lift Station. This budget amendment is
to fund preliminary engineering work for the revised design ideas. The consultant's scope indicates
a schedule of 100 days from the date of approval of their scope and fee. The additional work cost
total is $54,840.00
ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: The current budgeted spending in the Wastewater Impact Fee Fund will
increase by a total of $188,178.26. The FY19 estimated ending cash balance in the Wastewater
Impact Fee Fund will be decreased from $2,210,818 to $2,022,640. We have cash available due
to changes in the street reconstruction projects and timing.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING FISCAL YEAR 2019 (FY19) WASTEWATER IMPACT FEE
FUND BUDGET TO INCLUDE ADDITIONAL EXPENDITURES OF $188,178.
WHEREAS, the City Commission did, on the 25th day of June, 2018, after due and
proper legal notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2018-
2019 (Fiscal Year 2019); and
WHEREAS, the need to change the projects listed for funding in Fiscal Year 2019 in
the adopted Capital Improvement Plan; and
WHEREAS, the City Commission did, on the 13th day of August 2018, after due and
proper legal notice, conduct a public hearing on proposed amending the municipal budget.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, to wit:
Section 1 – Appropriation Changes
The City Commission of the City of Bozeman, Montana, does hereby authorize the
following changes to expenditures in the Wastewater Impact Fee Fund:
Additions: This project and amount is added to the FY19 budget.
Impact Fee Reimbursement $133,338.26 WWIF38- Additional Design work $54,840.00

Total Appropriations Changes: $188,178.26
Section 2 – Use of Cash on Hand in the Wastewater Impact Fee Fund
The increased appropriation will be funded with cash on hand in the Wastewater
Impact Fee Fund.
Section 3
Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full
force and effect on July 1, 2018.
Section 4
That should it be found by any court of competent jurisdiction that any section, clause,
portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law
or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman,
Montana, that all other portions, sections, words, clauses, phrases, or paragraphs of this document
shall remain in full force and effect.
