Res. 4948, CAHAB Purpose and Structure Revisions1 REPORT TO: Mayor and City Commission FROM: Matthew Madsen, Affordable Housing Program Manager Martin Matsen, Director of Community Development SUBJECT: Resolution 4948 Revising the Purpose and Structure of the Community Affordable Housing Advisory Board MEETING DATE: August 13th, 2018 AGENDA ITEM TYPE: Action STRATEGIC PLAN ALIGNMENT: The Community Affordable Housing Advisory Board supports item 4.5 (b) Housing and Transportation Choices – Develop a comprehensive Affordable Housing Action Plan. RECOMMENDATION: Adopt Resolution 4948 approving the revisions to the purpose and structure of the community affordable housing advisory board. PROPOSED MOTION: I move to approve Resolution 4948 Revising the purpose and structure of the Community Affordable Housing Advisory Board. BACKGROUND: On September 16th, 2002, the City Commission approved resolution 3540 which defined the purpose and structure of the Community Affordable Housing Advisory Board (CAHAB) which superseded Resolution 3056. After the hiring of the Affordable Housing Program Manager, staff was asked by the Mayor and City Manager to revisit the current resolution and provide some suggestions for creating a more efficient and effective CAHAB. The current resolution charged CAHAB with the following roles: 1. To examine all applications for assistance under the Community Development Block Grant CDBG) Revolving Loan Fund or the Community Housing Fund in light of the criteria established for expenditure of those funds, to solicit such information as it deems necessary in Commission Memorandum 204 2 order to adequately review said applications, to ensure that said applications meet eligibility criteria as outlined in the program guidelines for the respective loan programs, and to make funding recommendations to the City Commission; 2. To advise the City Commission on affordable housing needs, issues, policies and regulations; 3. To work with the City and other groups to formulate programs and projects to meeting Bozeman's affordable housing needs; and 4. To advise the City Commission on affordable housing plans for annexations and any related development proposals. With the hiring of an Affordable Housing Program Manager, there is now a full time staff position that is dedicated to the day to day management and operation of the Affordable Housing Program. Their job will be to fill the role of the existing sections two, three and four as well as other work and roles as defined in the Affordable Housing Program Work plan. In addition, the Affordable Housing Program Manager advise the City Commission through bi-annual updates and working with Planning on preparation of housing plans through developments, site plan and annexations that trigger the Affordable Housing Ordinance. Roles & Responsibilities: The updated roles and responsibilities will allow CAHAB to continue to serve in an advisory role to the city commission on issues pertaining to affordable housing to include: 1. Recommendations for approval of Affordable Housing Plans, Applications for City Support on Affordable Housing Developments 2. Being involved in the Community Housing Needs Assessment process 3. Review and score future housing related Community Development Block Grant applications 4. Work on projects as directed by the City Commission or Community Development Department Membership: The revision to the resolution changes the membership of CAHAB from nine voting members to seven voting members. This membership number matches many of the other Community Advisory Boards that are part of the City of Bozeman as well as other CDBG advisory boards in other communities. In addition, CAHAB currently has struggled with keeping a full board at the current nine member level. To achieve the seven members, the Real Estate Lending and Real Estate Sales representatives would be combined to create one Real Estate representative. Also, the representative from an organization which supports the availability of low to moderate income housing and the representative from a recognized affordable housing developer would be combined to create one representative from an organization which supports the availability of low to moderate income housing. In addition, the revision will create a community member at large position which allows for flexibility in having someone who may not fit into one of the traditional categories but still has expertise or interest in affordable housing. 205 3 The revision to the resolution also adds a 2-term or 6-year term limit for community members who serve on CAHAB. This does not currently exist for other advisory boards but staff recommends this addition. This will allow representation to change over time to provide new ideas and more diverse representation from the organizations and community members whom are affected by and interested in the issue of affordable housing. UNRESOLVED ISSUES: None determined at this time. ALTERNATIVES: 1. Direct staff to amend the resolution 2. As determined by the Commission FISCAL EFFECTS: At the current time, no money is being requested from the budget. Attachments: Resolution 4948 206 Page 1 of 4 RESOLUTION NO. 4948 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, REVISING THE PURPOSE AND STRUCTURE OF THE COMMUNITY AFFORDABLE HOUSING ADVISORY BOARD AND SUPERSEDING COMMISSION RESOLUTIONS NO. 3056 & 3540 WHEREAS, the City of Bozeman has created a Community Affordable Housing Advisory Board to aid in administration of the City’s Affordable Housing Program; and WHEREAS, the City Commission has established a Community Housing Fund, to assist in providing funding for different affordable housing options within Bozeman; and WHEREAS, the City Commission has tasked the Community Affordable Housing Advisory Board to review applications for the Community Housing Fund monies; and WHEREAS, the City Commission has determined that the purpose and scope of said Board should help facilitate the successful delivery of the Affordable Housing Program; and WHEREAS, the City Commission has determined that the composition of the Board should provide a proper community representation and efficient processes; and WHEREAS, the City of Bozeman has hired an Affordable Housing Program Manager to implement the Affordable Housing Plan and develop an Affordable Housing Program. 207 Resolution 4948, Revising the Purpose and Structure of the Community Affordable Housing Advisory Board Page 2 of 4 NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 - MEMBERSHIP That the "Community Affordable Housing Advisory Board" shall consist of no more than seven (7) members to be appointed by the City Commission. Members shall serve three (3) year staggered terms, with terms to end on June 30 of each year. Each member may be reappointed once beyond their initial term of service. Upon completion of two-terms a board member may apply for a different open position if they meet the requirements. Vacancies shall be filled in the same manner as original appointments for the balance of the term remaining. In addition to the appointed members, a member of the City Planning staff (Affordable Housing Program Manager) shall serve as a staff liaison and non-voting member. Members of the board shall be appointed as follows: 1. Real estate financing or real estate sales 2. Construction industry 3. Organization which supports low- and moderate-income housing in the community 4. Organization providing services to low- and moderate-income persons 5. Member of the public who has a demonstrated interest in special needs housing. 6. Member of the public certifying that he or she is a low- or moderate-income person whose income does not exceed 115 percent of the Area Median Income (AMI) 7. Community member at large If a position requiring a specific qualification remains vacant for three (3) months, the Commission may waive the requirement and fill a vacant position with a community member at large. Persons of legal age may be appointed to the Board. A majority of the members shall be residents of the city. Members who do not live within the city limits shall have a tangible connection with the city by virtue of working in the city, or owning property in the city. Members shall serve without compensation for their time and services. 208 Resolution 4948, Revising the Purpose and Structure of the Community Affordable Housing Advisory Board Page 3 of 4 Section 2 – PURPOSE The purpose of the "Community Affordable Housing Advisory Board" shall be as follows: 1. To review Affordable Housing Plans submitted to the Community Development Department Planning Office to include development plans for subdivisions with single household attached or detached home construction or affordable rental developments requesting city assistance and to provide recommendations, in the form of plan approval, funding requests or a letter of support to the City Commission; and 2. To advance the City of Bozeman’s Strategic Plan and the Affordable Housing Work Plan and Assisting with the Community Housing Needs Assessment; and 3. To be involved in the Community Housing Needs Assessment and Housing Work Plan Development process to include meeting with the consultant, assistance with community outreach and engagement, review of the draft and final report/presentation before presentation to the City Commission; and 4. To review and score any housing related Community Development Block Grant (CDBG) revolving fund applications that are submitted to the City and to make recommendations based off of scoring for the awarding of those funds on an annual basis; and 5. As directed by the City Commission or the Director of Community Development or Affordable Housing Program Manager to meet any other goals of the Affordable Housing Program; and 6. To serve as an advisory board to the Affordable Housing Program, Community Development Department and the City Commission.
