HomeMy WebLinkAboutEx 4 BPC 08092018 Resolution 2018 05 DISABILITY PoliciesDBOZEMAN PAKING CMMISSIONRESOLUTION 2018-05A RESOLUTION OF THE PARKING COMMISSION OF THE CIW OF BOZEMAN, MONTANA, ADOPTINGPOL¡CIES TO PROMOTE ACCESSIBILITY FOR PEOPLE WITH DISABIL¡TIESWHEREAS, individuals with mobility impairments may take more time than able-bodied individuals at aparking location to go to or return from their destination; and,WHEREAS, those individuals may not be able to spend as much time at their destination as an able-bodied individual due to the longer time needed to go to or from a parking stall; and,WHEREAS, the Bozeman parking Commission recognizes the importance of equal access for able-bodiedand mobility-impaired residents and visitors to homes and businesses; and,WHEREAS, residential parking permit districts limit or exclude vehicles without a permit from parkingnear residences; and,WHEREAS, an individual with a mobility impairment may need to park near their residence to safelyaccess their vehicle; and,WHEREAS, an able-bodied resident may choose to forgo purchase of a residential parking permit whilea mobility-impaired resident may lack that choice out of necessity; andWHEREAS, Bozeman City Code Sec. 36.04.560 indicates that a disabled parking stall may be designatedon a public right-of-way; and,NOW, THEREFORE, BE lT RESOLVED that the Bozeman Parking Commission adopts the following policiesregarding parking of vehicles displaying a current and valid disabled or disabled veteran license plate or disabilityplacard:L. A vehicle displaying a current and valid disabled license plate or disability placard may park for two. hours in excess of posted time limits in public time-limited disabled parking spaces without a fine.Parking beyond two hours in excess of posted time limits is subject to citation and fine. Vehiclesdisplaying a disabled license plate or disability placard must follow all other parking restr¡ct¡ons.Z. Residents who reside within a residential parking permit district who hold a valid disability permitfrom the Montana Motor Vehicles Division may request a fee waiver for all residential parkingpermits for vehicles that they own and regularly park at that residence.NOW, THEREFORE, BE lT RESOLVED that the Bozeman Parking Commission recommends that the Cityof Bozeman adopt a formal policy for the Public Works Department to establish and regulate the abilityof a resident in Bozeman who owns and regularly parks at their residence a vehicle with a currentdisability license plate or disability placard to request that a disabled parking space be designated in
front of that person's residence; and criteria for the approval or dismissal of an application to the Cityfor this purpose, including:o That no such space be provided if reasonably accessible off-street parking exists at the requestedlocation;o Considerationof lengthof validityof thedisabilitypermitgranted bytheStateof Montana MotorVehicles Division;o That disability parking signs are to be installed at the request of property owners;o That renters must provide a signed statement of consent from the property owner to havedisability parking signs installed;o That if the person requiring a disability parking zone moves, or their certificate expires and is notreissued, the property owner shall be responsible for notifying the Public Works Department, inwriting, that the disability parking zone is no longer needed;o And affirming that disability parking zones or stalls are not exclusive to any resident or propertyowner; ando That any vehicle with a valid disability license plate or placard may park in a designated disabledparking space.PASSED AND ADOPTED by the Parking Commission of the City of Bozeman, Montana, at a session heldon the 12th day of July 2OL8. This can lead to having to park muchfurther away from one's desired location, lt can also take much longer to enter and exit a vehicle and/oraccess their desired location for people with mobility impairments. Extending the parking limits foraccessible spaces by two hours can help alleviate these barriers and provide for a more accessíble andinclusive community.Additionally, being able to request an accessible parking space for residents would be beneficialto notonly the resident, but also to the community at large. lt would increase visitability, inclusion and access.Therefore, we are requesting your consideration for the following resolutions:1. Residential parking permits be available to drivers with a valid and current disability permit fromthe Montana Motor Vehicles Division for no cost.2. Draft a formal policy stating that residents may request that a disabled parking space (notexclusive to that person, but limited to vehicles displaying a disability license þlate or placard) beinstalled in front of their residence.3.
