Montana part~ of the tirst part, hereinafter cal~ed the Grantor__, and T~ CITY OF BOZEMAN, a munioipal corporation of the State of Montana, in Gallatin County, the party of the second part, hereinafter called the Grantee. WITNESSETH: WHEREAS, The Gran tor is the legal record title owner_ of portions of the NE~ of Section 30, T 2 S, R 6 E, MPM, and ~VHEREAS, the Grantee, in the exercise of its power and authority as a municipality of the State of Montana, proposes to oonstruct and install a waterpipe line for munioipal water supply from the m01,1th of Hyalite Canyon Southwest of the City of Bozemaro in a Northeasterly direction and Northerly direction to the said City of Bozeman, a portion of which proposed waterpipe line would run aoross the Grantor.:! land; and WHEREAS, the Grantee desires to acquire from the Grantor__, and the Gran tor 1s willing to grant to the Grantee en easement aCId right-of-way aoross the above described property of the Grantor_, and his heirs, txecutors, administrators, successors and assigns, for the purpose of install- lng, operating, using. re~airing, replacing, maintaining and removing said waterpipe line, and for such other rights of access and incidental rights 98 are hereinafter described, all as hereinafter more partio1,11arly provided. NOW, THEREFORE, in consideration of the sum of $ -- -50 .00, in hand paid by the City of Bozeman, the receipt whereof is hereby acknowledged. and in further consideration of the covenants and agreements between the parties hereto, the Grantor has granted, bargained, sold, conveyed, and confirmed, and by these presents does hereby grant, bargain, sell, oonvey, and confirm unto the said Grantee and its suocessors and assigns the following rights and privileges foreverz 1. A perpetual easement and right-of-way for the purpose of installing, operating, using, repairing, re~lacing, maintaining and removing a waterpipe -1- ." . ,. ::;,'1!)t< 1) .... (J'r' .. i ,\~lif :).. \) line and appurtenances thereto upon and across the above described property of the Grantor, said easement and right-of-way to consist of a strip of land thirty (30) feet in width lying and being fifteen-(l5) feet on each side of the follow- ing described center line: Beginning at a point on the North Line of Section 30. T 2 S, R 6 E, MPM, which l!oint is 1767 feet more or less, easterly from the North Quarter Corner of said Section 30; thence 819036' E, a distance of 66 feet; thence SlOo36'E., a distance of 1575 feet; thence S37056'E, a distance of 9lb feet; thence S12015'E, a distance of l5 feet, more or less. to a point on the 'Nest right-of-way line of the Sourdough Road. A total distance of 2571 feet or 155.82 rods or 0.49 miles. 2. The perpetual right of ingress and egress to and from said tract of land at all res.sonable times for the purpose of installing, operating, using, repair- ing;, replacing and maintaining said waterpipe line and appurtenances thereto and for the removing of same if and when desired by the Gra.ntee. its successors and assigns; TO HAVE AND TO HOLD the above described right-of-way with all the appurtenances and privileges unto the said Grantee and to its successors and assigns forever. The Grantee hereby covenants and egrees with the Grantor as follows: 1. That, in connection with the installing, operating, using, repairing, rerlacing;, maintaining and removing of said waterpipe line it will replace, at its sole expense, all existing fences, ditches and other apFurtenances of said land that may be disturbed by its operation in e condition equal to the condition thereof existing before said operations were begun, or as near thereto as shall be reasonably possible. 2. That, during operations involving excavation, it will remove the top- soil from the trench &rea to a depth of one foot, or to the full depth of the topsoil, whichever is less, and stockpile said topsoil away from the remainder of' the excavated material; and in backfilling, this topsoil will be replaced as the top one-foot of the trench. It will remove from the site any large rocks or surplus excavated material or an:l' kind of debris that may have been exposed by the excavation and remaining; after backfill- ing; is completed, and will leave the finished surfece in substantially the same condition that existed prior to the beginning of opera.tions, except that the surface of backfilled areas may be mounded sufficiently to prevent the formation of depressions after final settlement has taken pls.ce. 3. To install said waterpipe line at such a reasonable depth below the surface of the earth as will permit normal cultivation of the ground. 4. To operate, use and maintain said waterpipe line in such manner as will not hinder or prevent the proper oultivation of the tract through which this right-of-way is hereby granted. 5. Thst upon completion of construction and installation of said waterpipe line the Grantee will pay to the Grantor. in addition to the a.bove speci- fied money consideration for this easement, a lump sum of One Thousand Three Hundred Fifty Dollars ($1,350.00) for da.mages to the premises a.nd crops by virtue of the Grantee's entry thereon. The payment herein specified for damage to premises and crops shall be and constitute full payment to the Gran tor for any such damage caused to the Grantor's premises and current crops, as an incident to the initial construction and installation of the waterpipe line. 6.
