RELEASE OF EASEMENT, FOR SANITARY SEWER
AS SET OUT IN THE PLAT OF BOZEMAN INDUSTRIAL PARR
WHEREAS, there appears, on the face of the Plat of Bozeman
Industrial Park, situate in the SW~ of Section 31, Township 1 South,
Range 6 East, P.M.M., a 30-foot wide sanitary sewer easement running
north and south along the west line of Tract 3; and
~~HEREAS, except for the south IS feet of Tract 3, no legal
transfer of said easement appears of record, and there appears to
be no need for said easement along the west line of Tract 3, and
the City of Bozeman does not now and never did claim any right or
title to said easement except along the south 15 feet of Tract 3.
1. The City of Bozeman hereby conveys, remises, releases
and forever quit claims unto the owners of Tract 3 of Bozeman
Industrial Park, their heirs and assigns, all of its right, title,
interest and claim, if any, in and to that certain 30-foot wide
sanitary sewer easement shown along the west side of Tract 3 of
Bozeman Industrial Park, except reserving unto the City of Bozeman
the IS-foot easement along the south line of said Tract 3.
Said easement as before mentioned shall henceforth cease
to exist and the City of Bozeman hereby abandons any claim, right,
title or interest in and to said easement, if any, it may have.
IN WITNESS WHEREOF, the City of Bozeman has h2reunto set its
hand by its City Manager and its Clerk of the City commission, each
thereunto duly authorized and has caused its corporate seal to be
affixed, all on this 18th day of
March , 1985.

RE: Release of Easement - Tract 3, Bozeman Industrial Park
I have included, as Attachment "A", the standard release of
easement form which was prepared by the City Attorney. As
you can derive, the form applies to an easement garnered by
an easement form. The easement requested to be abandoned for
the referenced parcel was apparently created by being included
on the face of the subdivision plat for Bozeman Industrial
Park. I have not found an easement either in my files or the
County Courthouse records.
In this instance, it appears that the wording included in the
material you sent to me is more appropriate for this request.

I have reviewed the attached request to abandon a sanitary sewer easement
on Tract 3, Bozeman Industrial Park. I was not able to derive any infor-
mation which indicated the need for the easement. I concur with the re.
quest to abandon the easement as indicated in yellow on the attachment.

Dear Mr. WIlliams:
He have reviewed the sewer easements referred to in
your letter of May 17, 1984, and are unable to determine
a need to retain the easement shJwn on the west edge of
Tract 3 in the Dozeman Industrial Park.
&vidently this was provided for when the industrial park
was platted.
Please furnish the docwrracnts required for abandonment of
the easement by the City.
