" .... . . 94 PAGE 4570 -, filM SANITARY SEWER AND WATER PIPELINE EASEMENT AND AGREEMENT AND EMERGENCY VEHICULAR ACCESS The undersigned, as GRANTORS, in considpr~tion of Ten Dollars ($10) and other good and valuable ccnsiopration, receipt of which is acknowledged, gral~t tc the City of Bozeman, a municipal corporation of the State of Montana, 411 East Main, Bozeman, MT 59771-0640, GRANTFE, its successors and assigns, a perpetual easement (1) for a fire lane for the express purpose of unrestricted and ilTlmediate u ~(' b\' any emergency vehicle, and (2 ) for the construction and nlaintenance of sanitary sewer and water pipelipes with the usual services, valves, connections, accessories a ncl i'lppurtenances for t hf'.' purpose of transmitting sanitary sewage anc water in, through, and across a strip of 1 a r.d s i tUEl ted in Gallatin County, ~ontana, eleven ( 11) feet wide en eAch side of the centerline to be located on the followiny described real property: Lot 5 , Remington Addition to the City of Bozeman, according to the official plat thereof as filed and of record ir: the Office of the Clerk and Recorder of Gallatin County, Montana. The centerline is more particularly described on the attached Exhibit A, which by this refE~r(-'nce is made a part hereof. This grant includes the riCJht of the GPANTEE, its successors, perrrittees, lic<-:n~3(',::2 , (l nd assiqns and its and their agents and emploYf~es , to t.'lltc~- 2t 211 times upon the above-describE'd land by us ir'iq cxi~;tinq rnads or trails or otherwise by a reAl t E' C (';1.;2 Hlt1 the 1 r' ~\ ~, t ci'lTT'age and inconvenience to the GRANTORS in order tn survey and establish the route and location of the easement and the pipeline and to: . .. , . .:.. . 1 FILM 94 PAGE 4571 +, (1) Construct, operate, patrol, repair, substitute, remove, enlarge, replace, and maintain the pipeline, services, connections, accessories und appurtenances; (2) Trim, remove, destroy, or otherwise control any trees and brush inside or outside the boundaries of the easement which may, in the opinion of the GRANTEE, interfere or threaten to interfere with or be hazardous to the construction, operation and maintenance of the pipeline or to the use of the easement by emergency vehicles; (3) Grade> the land subject to this easement and extend the cuts and fills of this grading into and on the land adjacent to that which is subject to this easement to the extent GRANTEE may find reasonably necessary: and (4 ) Support the pipeline across ravines and water courses with structures which GRANTEE deems necessary. The GRANTEE agrees that: (1) That, in connee tion with the cOt,~- t ruct ion, operating, patrolling, repairing, ~l1b5tituting, r PIT\OV i ng , enlarging, replacing, ar.d maintaining of said sanitary sewer and water pipelines, it will repa i 1 or replace, at its sole expense, or pay to GRANTORS the reasonable value of any damages to road surface and other appurtenances of said land that may be disturbed by its operation. (2 ) That, during operations involving excavation, it will remove the topsoil from thp trenched area to a depth of one foot, or to the full depth of the topsoil, whichever is less, and stockpi 11...' said top soil for replacement over the trench. In addition, they vii 11 neither allow vehicles to be parked upon the easement nor allow any other use which would interfere, or threaten to interfere with or be hazardous to the use of the casement by emergency vehicles.
