K_ m —_ r S— 0U- WHEREAS, the City of Bozeman received a petition for annexation from the Bozeman ey= Interim Public Works Director requesting the City Commission to extend the boundaries of the City N ro= of Bozeman so as to include an area of land containing approximately 1.0444 acres, located at the ���= northerly terminus of N. Rouse Avenue; and �om (D °= WHEREAS,The City of Bozeman is the sole and current landowner of record of the real U) N mz� property to be annexed; and WHEREAS, an annexation staff report was prepared in accordance with the Commission's goals and policies for annexation and was presented to the Commission on June 11, 0 2018; and J d WHEREAS, a public meeting on said annexation petition was duly noticed and held on June 11, 2018; and WHEREAS,the City did not receive any written protest from the real property owners of the area to be annexed; and Page 1 of 3 Resolution 4916, 2018 City of Bozeman N. Rouse Avenue Annexation WHEREAS, on June 11, 2018,the Commission approved the annexation; and WHEREAS, the provision of available services, including, but not limited to, streets, rights-of-way, easements, water rights or cash-in-lieu, waivers of protest against creation of SID's, and water and sewer hookup fees,to said contiguous tracts as described is the subject of an extension of service plan as allowed by state law; and WHEREAS, the Bozeman City Commission hereby finds that the annexation of this contiguous tract is in the best interests of the City of Bozeman and the owners thereof. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana,that: Section 1 That it is hereby declared that,pursuant to Title 7, Chapter 2,Part 46,Mont. Codes Ann.,the following-described property, which is contiguous to, and wholly surrounded by, the municipal boundaries of the City of Bozeman, be annexed to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and include such approximately 1.044 acres,to wit: Description of Property to be Annexed That triangular area of previously unannexed land lying north of Tract 33, Northeast Annexation, annexed by City of Bozeman Ordinance 964 and shown on 33 Film 1966 of the records of the Gallatin County Clerk and Recorder, and south of Tract GL1, Certificate of Survey 1221, all in the in the Southwest quarter of Section 31, Township 1 South, Range 6 East, PMM Gallatin County Montana, and being approximately 1.0444 acres, with corner points at: Latitude Longitude Northern Point 450 42' 15.553"N 1110 2' 4.374" W Western Point 450 42' 13.319" N 1110 2' 6.480" W Page 2 of 3 Resolution 4916, 2018 City of Bozeman N.Rouse Avenue Annexation Eastern Point 450 42' 13.356"N 1110 2' 0.119" W Section 2 This resolution and annexation are effective upon passage.
