SUBJECT: Authorize the City Manager to sign the Agreement for New Bozeman High School Water Adequacy Requirements with Bozeman High School District 7.

RECOMMENDATION: Authorize the City Manager to sign the Agreement for New Bozeman
High School Water Adequacy Requirements with Bozeman High School District 7.
BACKGROUND: Prior to approval of development applications, applicants are required to provide water rights, or cash-in-lieu thereof, to cover their anticipated future annual water demand. The total water rights cash-in-lieu calculation for the new high school is $439,028.00, of which
$413,053 is for irrigation use, the remainder for interior domestic use. Through this agreement,
prior to site plan approval, the school district will pay $24,075, as shown in Table 1 of the attached Agreement for the domestic uses. The Agreement allows the District up to 36 months to either acquire adequate irrigation water rights, or if adequate rights cannot be obtained, pay the remaining amount owed for irrigation use.
