NOA to Knife River for Baxter Lane Improvements, Davis to N. 19thCommission Memorandum REPORT TO: Honorable Mayor and City Commission FROM:Bob Murray, Project Engineer Rick Hixson, City Engineer SUBJECT:Baxter Lane Improvements Project from Davis Lane to North 19th Avenue –Notice of Award MEETING DATE: July 16th, 2018 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to Knife River - Belgrade. for the Project Bid Price in the amount of $4,147,364.00, and final contract documents once received. BACKGROUND: Attached is a copy of the Notice of Award for the above referenced project. The project is for the construction of Baxter Lane between North 19th Avenue and Davis Lane. It includes roadway widening and reconstruction, new corridor lighting with LED luminaires, new sidewalk, new storm drain infrastructure, new water main, signalization of the intersection of Baxter and Davis, and utility adjustments. Bids for the above-referenced project were opened on June 19, 2018 with 3 bids being submitted. The low bid was submitted by Knife River - Belgrade for the Project Bid Price of $4,147,364.00. Then engineers estimate for the project was $3,727,681.50. As discussed in the attached award recommendation letter from our consultant, this is likely due to the late bid date. Bidding on the project was delayed while attempting to obtain right of way from the property on the northwest corner of Baxter and Thomas. Those efforts to date have failed, so we removed the curb and sidewalk along their frontage to allow the project to be bid utilizing the existing right of way. If the right of way can be obtained for this parcel as the project progresses, we can add the curb and sidewalk back in to complete the entire corridor. The project is budgeted in the Capital Improvement Plan (CIP) at $4,000,000.00. This is the combination of two projects; SIF055 for the corridor between 19th and Davis, and SIF121 for the Baxter/Davis intersection improvements. Each of the CIP projects are funded through a combination of Arterial and Collector, and Impact Fee funds. After reviewing the bids, a few changes have been identified, that if made will allow the project to move forward within the existing budget. Revising the road section to use a thicker asphalt section with less gravel, 107 removing the chip seal, and replacing all thermoplastic pavement markings with epoxy paint will result in an estimated savings of $277,872.00. The alternate section will provide the same structural capacity as what was bid, so the life of the road will not change. The chip seal and thermoplastic striping can be completed in the future as part of the annual street maintenance project. Knowing we will be chip sealing the road in the near future would normally cause the change in striping that is being recommended to avoid additional costs at the time of chipping. More detail is provided for each of these items in the attached consultant’s award recommendation letter and a letter from Knife River detailing the specific cost breakdown. The attached notice of award is for the entire $4,147,364.00 based on the bids received. The changes described above cannot be made until the contract is in place. The reductions will be made in a couple of different ways. The reduction in the cost for the street section will be a result of changes to the asphalt and gravel quantities on the project. The chip seal unit price item will simply not be used, and the change to the striping item will be made by a change order which will be processed once the contracts are signed and in place. The Notice of Award, Award Recommendation from our consultant, and Bid Tabulation are attached. UNRESOLVED ISSUES: None ALTERNATIVES: Reject all bids and re-advertise next year. FISCAL EFFECTS: The project will be paid from the Street Impact Fee Fund, the Arterial and Collector District Fund. You are the apparent Successful Bidder and have been awarded a Contract for the: Baxter Lane Improvements Project from Davis Lane to North 19th Ave. The Contract Price of your Contract is: Four Million One Hundred Forty Seven Thousand Three Hundred Sixty Four Dollars ($ 4,147,364.00). Five (5) copies of each of the proposed Contract Documents (except Drawings) accompany this Notice of Award. Three (3) sets of the Drawings will be delivered separately or otherwise made available to you immediately. You must comply with the following conditions precedent within fifteen (15) days of the date of this Notice of Award, that is, by July 31, 2018. 1. You must deliver to the OWNER Five (5) fully executed counterparts of the Agreement including all the Contract Documents and Drawings. 2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the Instruction to Bidders (Section 24-26), and the General Conditions (paragraph 5.01). 3. List other conditions precedent: You must deliver with the executed Agreement the Certificates of Insurance as specified in the General Conditions (Article 5) and Supplementary Conditions (paragraphs SC-5.04 and SC-5.06). Failure to comply with these conditions within the time specified will entitle OWNER to consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited. Within ten (10) days after you comply with these conditions, OWNER will return to you two fully signed counterpart of the Agreement with the Contract Documents attached. RPA has reviewed those bids, and are furnishing the accompanying Certified Bid Tabulations. RPA has also conducted an engineering check of the bids for conformance to the Contract Document requirements, including the following:  Mathematical verification of the bid amounts, extensions, and totals. Any mathematical errors are shown or noted on the Bid Tabulations.  Review of bid forms from the apparent low bidder for proper signature and acknowledgments. No irregularities were noted in the low bid.  Acknowledgement of receipt of all Addenda.  Low bidder included the Montana Contractor’s license number and the required executed certifications in the Official Bid Proposal and a signed Non-Discrimination Affirmation Form.  Review of bid bond from the low bidder. Bid bond appears proper and duly executed. The low bid of $4,147,364 exceeds the City of Bozeman’s budget amount of $4 million. This is likely due to advertising the project during the summer construction season. There are many other large-scale construction projects currently underway this summer in Bozeman with a limited supply of local Contractors. The summer advertisement was due to the timeline of acquiring right-of-way along the corridor. The adjacent Baxter Lane project from 19th Ave. to 7th Ave. was advertised in February/March 2018, and the low bid was approximately 20% under budget. If a budget amendment cannot be obtained for this project, the Contract Documents state the following: Instructions to Bidders #22. Method of Award. b. If such lowest bid exceeds the budget, the Owner may reject all bids. However, this project is critical to Bozeman’s street network and provides safety upgrades, pedestrian and bicycle facilities, and a link to the water distribution network. Re-bidding this project will likely delay the start of construction to the 2019 season. 110 2 | Page At the request of the City, RPA has investigated potential cost saving measures to consider should award be made by the City. These items may include the following options:  Revise the recommended 37” pavement section (5” asphalt, 8” base course, 24” subbase course) to a 23” section (6” asphalt, 17” base course). The thinner section meets future traffic conditions, but will likely require additional subexcavation of the poor subgrade if installation is during a rainy period. Subexcavation areas are unknown until they are exposed during construction.  Replace thermoplastic pavement markings with epoxy. (Note: thermoplastic is a City of Bozeman standard requirement).  Eliminate the chip seal, and provide it in the future through a different funding source. (Note: chip seal was part of the original project scope). Please see the attached letter from Knife River regarding specific cost savings for each item.
