According to the BozemanCity Attorney, in considering this request, the Bozeman Parking Commission mustdetermine tf "aII or part of the required parkíng spaces cannot be províded for aproposed use in the B-3 Distric7 either by ownership of lease of the necessary land."The decision of the Bozeman Parking Commission on this question would thendetermine if the applicant's request for Cash-ln-Lieu is approved.In addition to the Parking Program Manager, staff from the CommunityDevelopment Department and City Attorney's Office will be present at the luly 72,2018,meeting of the Bozeman Parking Commission when this matter is considered.9-P.O. Acopy of this certificate shall be presented to the chief building official and planning director before abuilding permit is issued or the use instituted;(3) For each required parking space not provided, payment shall be made to the city administrative servicesdepartment as specified by standard payment requirements established by the parking commission;(4) All real property assessed by special improvement district (SID) No. 565, or other similarly adoptedimprovement districts designed to provide additional parking spaces within the B-3 district, shall not berequired to provide additional parking spaces beyond those required at the time of the SID adoption,provided the use of the real property and improvements remains unchanged from the initial assessments ofSID No. 565, or other similarly adopted improvement districts;(a) In the event that a new use or an expansion is initiated on any portion of real property or improvementssubsequent to the assessments for SID No. 565 or other similarly adopted improvement districts, thenparking space requirements shall be satisfied prior to initiation of those new or expanded uses. Document 26L4497. Lot 6A is a distinct and separate parcelcurrently under site planreview. This request is specifically for Lot 1A for the purposes of a future improvement of theproperty. Per the requirements of sectiori Sec. 38.540.050.2.b.a , we are formally petitioning for 7cash in lieu parking spaces to satisfy the upcoming expansion and change of the building'The property owner of Lot 1A , totaling 15,591 square feet of the amended plat of recorddocument 26L4497 currently includes 33 residential apartments. This building was built pre-dating the advent of modern zoning rules or laws pertaining parking. Prior to making changes toimprove the fire safety of the building, we must bring the property into compliance regardingparking requirements.The subject property current has seventeen (17) parking spaces per SID 565 and nine (9) onstreet parking spaces. This requires the addition of 7 parking spaces.
