PMM, 1328.56 feet north of the Southwest corner of said Section 32,

2. The perpetual right of ingress and egress to and from
.aid tract of land at all reasonable times for the purpose of installing,
ope~ating, using, repairing, rcplacinR and maintaining said water
maln and for the removing of same if and
when desired by the Grantee, its successors and as.lgns:
TO HAVE AND TO .~LO the above described right of way with
all the appurtenances and privileges unto the said Grllntee
and to ita successors and assigns forever.
The Grantee hereby covenants and agrees with the Gralltor_
as follI'JWs:
1. That, in connection with the installing. operating,
u.ing, repairing, replacing, maintaining and removing,
of .dd water main it will replace at its
.ole expense, all existing fences, ditches and other appur.

in a condition equal to the condition thereof exiAting before
.aid operations were begun, or as near tbereto as shall be
rea.onably possible.
2. That, during operations involving excavation, it will
remove the topsoil from the trench area to a depth of one
foot, or to the full depth of the topsoil whichever 1s less,
and stockpile said topsoil for replacement over the trench,
and will remove from the site any large rocks or surplus
excavated material or any kind of dchds that may have been
exposed by the excavation and remaining nfter hllckfilling
18 completed and will leave the f inhhed surface in subs tan.
tially the same condition that existed prior to the beginning
of operations except thllt the surftlce of backfilled areas may
be mounded sufficiently to prevent the formation of depressions
after final settlement has taken place.

in Auch manner as w111 not hinder or prevent the
proper cultivation of the tract thrnugh which this right of
way i. hereby granted.
4. In the event that it sholid become necessary for the
Grantee to re.enter the Grantors premises for the purpose
of repairing. replacing, maintaining or removing said utility
lines the Grantee will reimburse the Grantors for any actual
damage done to the Grantors premises or crops.

The Grantor__ hereby c~venant9 and agrees with the Grantee as f~11ow8:
l. That at no time will they build, construct, ~rect or ~lintain
any permanent structure flver or above the s.lid _ water main
unless such structure is built, constructed
and maintained in such a manner ttwt it would not interfere
with the operation, URe, repair, mnintain~nce, rcplacC'ment
and removal of said water main .
2. That the Grantee may peaceably hold find enjoy the rightH
snd privileges herein granted without any interruption by
the Grantof__ or ~ successors nnd 8ssigns.
3. That they have been lawfully sei~ed of said premises; that
they have good right and lawful Authority to sell the Borne
and that they and the ir hel rs, executors, admlnfstratrrs,
successors snd assign8, Bhall warrant and defend the title
to said premises unto said Grantee, and itB successors and
aS8igns forever, against the lawful claim and demand nf all
persons whomsoever.
It is understood and agreed by and between the partics hereto that
this Agreement shall be binding upon the heirs, eXecut~rs, adminifitrntors.
8uccessor and assigns of the Grantors and upon the successors and
assigns of the Gr3ntee.
1. That the gravel layer on Sourdough Road will be increased to
5 inches.
2. The contractor will be required to begin the project on the
northern most end, near the four million gallon reservoir
at Sourdough Road and Goldenstein Lane.
3. The City will guarantee that the contractor will replace the
disturbed portions of Sourdough Road to the same, or improved,
condition by the conclusion of the project.
4. That water taps will be extended to the edge of the right-of-
way for the residents. Mr. R. P. ~1yers, ,1r. and ~1r. Bill r~yers,
for connection at a time convenient to the Grantor.
